was listening in during the hearing... was going to say that the judge more or less seemed inclined to believe he had article 3 jurisdiction, didnt sound all that satisfied with defendants' responses. but he really wasn't having plaintiff's arguments on laches.
he also acknowledged that it is very unlikely he will be the final voice on this, in that its getting appealed one way or the other
