In 1876, Congress could not agree on whether or not to count the electoral votes.
The Democrat controlled House refused to allow even the envelopes to open.
The Republicans alleged electoral fraud, while the Democrats claimed that no such fraud had occurred.
Congress missed ALL THE DEADLINES it was required to meet.
Adding up the state certifications resulted in the following totals:
(R) Rutherford B. Hayes = 165 electoral votes
(D) Samuel J. Tilden = 184 electoral votes
Disputed = 20 electoral votes
A candidate needed 185 electoral votes to win.
The 20 disputed electoral votes came from 4 states.
Because the Democrats refused to admit fraud had taken place, a solution was crafted:
The Electoral Commission Act (19 Stat. 227) was signed into law by President Ulysses S. Grant.
The Electoral Commission consisted of 5 House Democrats, 5 Senate Republicans, and 5 Supreme Court justices.
It would deal with the 20 disputed electoral votes.
The Electoral Commission awarded all 20 electoral votes to (R) Rutherford B. Hayes.
The Democrats THREATENED to filibuster the results, so an informal, awful, and unprecedented deal called "The Compromise of 1877" was made:
In return for the Democrats ACCEPTING Rutherford B. Hayes as POTUS, reconstruction would be ended and all federal troops would be withdrawn from the South.
For the Democrats, electoral fraud paid off.
They took control of the South for a century, and continued robbing black Americans of their full rights as citizens.
The Election of 1876 was not resolved until 2 DAYS before Inauguration Day.
