OK, my business has an 8' fence with no trespassing signs all around it. One of our local homeless guys climbed over the 8' fence last Saturday night about midnight. Our motion detectors and cameras immediately picked him up. We immediately called SAPD and went to meet them. Meanwhile, I am watching him on the camera poking around looking for a way into our buildings and hitting on his meth pipe. He did that at least 6 or 8 times before we got there and we have it all on video. When the police finally got there we let them in the front, took them out a back door and the police caught the guy red handed in the act of trying to break into a door to one of my storage buildings. Seems pretty clear cut, right? The stoned asshole told the cops he thought his wife was locked up in our building and that is why he was trying to break in. Huh?
No arrest. The cops said we had to have already warned him in person not to trespass on our property. That was total bull and we pointed it out to them that our 8' fence and signs cons uted a warning according to Texas penal code 30.05. They kept saying 'we have warned him now so next time he breaks in we can arrest him". We told the cops about the meth pipe and they didn't even search him. They just loaded him in their patrol car to appease us and went down the street and let him out.
Here is the penal code:
Sec. 30.05. CRIMINAL TRESPASS. (a) A person commits an offense if the person enters or remains on or in property of another, including residential land, agricultural land, a recreational vehicle park, a building, a general residential operation operating as a residential treatment center, or an aircraft or other vehicle, without effective consent and the person:
(1) had notice that the entry was forbidden; or
(2) received notice to depart but failed to do so.
(b) For purposes of this section:
(1) "Entry" means the intrusion of the entire body.
(2) "Notice" means:
(A) oral or written communication by the owner or someone with apparent authority to act for the owner;
(B) fencing or other enclosure obviously designed to exclude intruders or to contain livestock;
(C) a sign or signs posted on the property or at the entrance to the building, reasonably likely to come to the attention of intruders, indicating that entry is forbidden;

any two-bit lawyer (even a court appointed one) could get the alleged trespasser off in YOUR scenario by simply saying
a) he didnt see the sign
b) it was dark/rainy/too high on the wall/fence - too low /too obscure, etc
c) his client did not have his glasses
d) no one TOLD HIM to leave (hence why the cops said - NOW he has been advised and if he comes back NOW - they can arrest him for criminal trespassing)
stop being LAZY and follow the law and you can get him PROPERLY ARRESTED
