Reportedly the classification power has nothing to do with the Presidential Records Act or the Espionage Act. According to the former, all presidential records belong to the National Archives when the president'sterm is over; under the latter, national defense information of any kind -- classified or declassified -- is protected.

I agree there are all sorts of possibilities to charge if they are so inclined, the question is if they will do it. Going after a former President on the Presidential Records Act is a of a precedent and is going to look blatantly political. They may want to avoid that now that the records are safe.

I think he'll actually skate on that stuff barring a flip by one of the inner circle. The liability is really diffuse.
The classified and defense information and obstruction violations here are so clear here I can't see Trump's getting away with them.
So basically any President from here on out can just go ahead and take classified docs on the way out the door because the worst case scenario is they'll just have to give them back.
I think this probably would've gone away if Trump had coughed up all the do ents the first time around.
