fox will not be required to issue an on-air apology or retraction per the settlement
Not much you can do to help idiots like those two, as they are pre-programmed to believe the conspiracies.
Who knows if the pending Smartmatic lawsuit will be as interesting or as costly as this one.
Smartmatic is suing Fox News for $2.7 billion for defamation.![]()
fox will not be required to issue an on-air apology or retraction per the settlement
But with all the sworn statements and emails, a motion picture on the events would be interesting.
Uhhh they did push a storyline about Dominion voting machines being rigged.
They did not settle for 780 million dollars because they are a fine journalistic outlet.
except the fact they settled appears to make FOX, in its own opinion, a fine journalistic news station.
and.... they claim their major "news anchors" should not be taken seriously by rational people?
This is the most popular news network and they are totally fked up, this says something important about the red team devotion to lies.
sounds like Fox has learned its lesson
right wing media caught lying
paid 800 m for it
today's right wingers
their claimed damages are upwards of 2.5 billion and im pretty sure that in the US, smartmatic was literally only used in LA county
ergo, reporting that Smartmatic screwed Trump is an even bigger whopper than fact-free claims that Dominion did so.
seems like the difficulty of proving injury might have moved Dominion to settle, mightn't the case be similar for Smartmatic?
well, in the big summary judgment ruling, the court did find that dominion had already established that it was damaged. there is a concept in defamation called "defamation per se" which basically means that the element of damages are met if the nature of the defamatory claim inherently attacks the person/en y's professional/business reputation. ie it would not be defamation per se if i was talking about a famous financier and saying this guy doesnt shower and has bad BO. it has nothing to do with his ability to do business. if i lied and say these guy has a history of embezzlement or money laundering, that would fall under defemation per se. saying that an election service company rigs elections... yeah thats an obvious one too.
so the court found that dominion had already established damages as a necessary element of their defamation claim. the extent of the damages was still to be proven, but i dont think that was the real hang up. the remaining legal issue at trial was whether or not Fox acted with "actual malice" which is always the biggest hurdle in these cases of defamation involving public figures. you have to prove not only that the statements were false, but also that the speaker knew that they were false or acted in reckless disregard of its falcity. its a pretty high burden. there did appear to be pretty solid evidence of that in the released text messages, but the mere fact that some behind the scenes producer or agent didnt believe the claims doesnt necessarily mean that, say, dobbs or bartiromo felt the same way at the time they made their statements
but given the scope of dominion's involvement nationally, i think damages would not have been difficult to drum up
thanks for your detailed reply

smartmatic would probably have the same defamation per se aspect going for them, but would similarly have to prove actual malice (it was the only issue remaining in the dominion case had it proceeded to trial). but i have to think they would have a much harder time establishing the extent of the damages than dominion would have. if they settle it would presumably be for way less, but the demand in their lawsuit does seem outrageous on its face, imho
ive only worked one defamation case but it wasnt a public figure so rules were very different. no actual malice standard needed. need to just prove that there was some amount of negligence in the statement, and not that they actually KNEW the info was false (or acted in reckless disregard yada yada)
the burden is higher for public figures because they are deemed newsworthy and you dont want to deter journalists/press from reporting out of fear
Tucker got canned.
Good riddance to smelly garbage.
Faux news: “hey cucker- how do you feel about actually reporting the news and basing your show on facts?”
Cucker: “what?… and what about all my idiot sheeple who CRAVE MY LIES? No ing way - im out!”
https://www.cjr.org/the_profile/tucker-carlson.phpCarlson applied to the CIA, but his application was denied, so he turned to journalism. “You should consider journalism,” his father told him. “They’ll take anybody.”
huh, wonder what happened.
refused to toe a new editorial line? caught screwing a teenager? running for office?
there are still live lawsuits against Pirro and Bartiromo
I could totally see Tucker refusing to apologize and quitting in a snit.
https://www.nytimes.com/2023/03/23/u...r-carlson.htmlA lawyer for Ray Epps, the man at the center of a prominent conspiracy theory about the Capitol riot, sent a letter on Thursday to the Fox News host Tucker Carlson demanding that he publicly retract his “false and defamatory statements” that Mr. Epps had worked as a government provocateur on Jan. 6, 2021, and helped to instigate the mob attack.
The letter to Mr. Carlson from the lawyer, Michael Teter, also demanded a “formal on-air apology for the lies” that have been “spread about Mr. Epps” by others at Fox.
“The fanciful notions that Mr. Carlson advances on his show regarding Mr. Epps’s involvement in the Jan. 6 insurrection are demonstrably (and already proven to be) false,” Mr. Teter wrote. “And yet Mr. Carlson persists with his assault on the truth.”
Letters seeking retractions and apologies are often sent when lawyers are preparing to file a defamation lawsuit.
Tucker is an American journalist Hero. Wouldn't accept being a political party mouth piece. USA media needs more Tucker's.
comments related to Abby Grossberg or newly revealed info in her lawsuit?
daboom1 Can’t Cuck The Tuck, amirite? Welp…
One of his last actions at Fox was to be the Republican Party mouthpiece by fawning all over Trump in that interview.
