    “We have been litigating based upon this false premise that Rupert Murdoch wasn’t an officer of Fox News,” he said.

    Judge Davis declined to deconsolidate the case but expressed concern that Fox’s legal team had not been forthcoming with the information, despite being asked multiple times whether or not Mr. Murdoch was a corporate officer for Fox News.

    “I need people to tell me the truth,” he said. “And by the way, omission is a lie.”

    Dan K. Webb, a lawyer for Fox, pushed back on the assertion from Dominion, saying that both he and even Mr. Murdoch himself didn’t realize he also held the executive chair role at Fox News

    Instead of citing bank records or net worth statements, Giuliani’s defense lawyers filed a trio of recent news articles illustrating the former mayor’s financial condition falling apart: “Rudy Giuliani’s Consulting Firm STILL Won’t Pay Its Bills,” “Report: Rudy Giuliani Is ‘Close to Broke,’ Prepared to Go to Prison,” and “Rudy Giuliani Puts His Upper East Side Apartment Up for Sale”.

    “We thought these articles showing that he was close to broke would be sufficient,” Giuliani’s attorney Adam Katz said at Wednesday’s hearing.

    “There are a lot of bills that he’s not paying: from a $57,000 phone bill to significantly more," the Russo Law attorney said. "I think that this is very humbling for Mr. Giuliani.”
    Judge Cohen was not convinced by the defense's request to ask Smartmatic to foot the $12,000 to $18,000 bill for Giuliani’s electronic discovery vendor, TrustPoint One.

    “This is something you agreed to do, this is something you need to do, Mr. Katz,” the judge patiently reprimanded.

    Newsmax bends the knee

    The pro-Trump cable outlet Newsmax and voting technology company Smartmatic settled a major defamation lawsuit Thursday in a last-minute agreement, averting a high-stakes trial over the airing of false 2020 election claims.

    The terms of the settlement were not immediately known. The deal comes hours after jury selection got underway in a Wilmington, Delaware, courtroom ahead of opening statements scheduled for Monday. The parties, and a court official, announced the settlement Thursday afternoon.

    “Newsmax is pleased to announce it has resolved the litigation brought by Smartmatic through a confidential settlement,” the network said in a statement.

    A New York state appeals court on Thursday rejected Fox's bid to dismiss a $2.7 billion defamation lawsuit by voting machine company Smartmatic over statements made on air following the 2020 U.S. presidential election.

    The decision was issued by a five-judge panel of the Appellate Division in Manhattan.

    Newsmax settles with Smartmatic for $40M

    The conservative news outlet Newsmax agreed to pay the voting equipment company Smartmatic $40m last year as part of a settlement in a defamation suit over Newsmax’s decision to broadcast false claims about the 2020 election, a new filing revealed.


    The parties did not reveal details of the settlement when it was reached in September, but Newsmax disclosed the settlement amount in a public 7 March financial filing. The news outlet said it had also offered Smartmatic the option to buy stock in the company and that it had paid $20m of the settlement amount so far.

    A Newsmax spokesperson declined to comment beyond the statement the company issued after the settlement last year.


    Smartmatic voting equipment was only used in one jurisdiction in the United States during the 2020 election.

    Nonetheless, allies of Donald Trump and other conservative outlets repeated false claims that the company hacked votes and sent them overseas.

    Dominion lawsuit against Newsmax scheduled for trial

    A Delaware judge, once again, has found that a conservative news outlet broadcast false and defamatory claims about the role a voting technology company played in the 2020 presidential election. This time, that network is Newsmax, Fox News' upstart rival, which is fresh off a successful initial public offering.


    Following Joe Biden's victory over Donald Trump that November, Trump's allies and supporters took to right-wing media to accuse Dominion Voting Systems of rigging the vote to help Biden.


    In his opinion, Judge Eric M. Davis says Dominion "presents clear and convincing evidence" that shows Newsmax broadcast segments with inaccurate information that "would likely cause reasonable viewers to think significantly less favorably about Dominion than if the viewers knew the truth." He also noted that Newsmax's "clarification" posted in mid-December 2020 about a lack of evidence of voter fraud showed that Newsmax "acknowledged the falsity" of several lies regarding Dominion and the election.


    If the lawsuit heads to trial as scheduled later this month, the jury will be asked to decide whether to award damages and how much, and whether the broadcasts were aired with "actual malice," which means knowledge of falsity or disregard for the truth.

    Donald Trump signed an executive order on Wednesday punishing the law firm that helped Dominion Voting Systems obtain a $787.5m settlement from Fox for lies about the 2020 election.

    The order against the firm, Susman Godfrey, marks the latest effort by the president to punish attorneys and firms who have opposed his interests.

    The order seeks to harm the firm by limiting its attorneys from accessing government buildings, revoking security clearances and essentially making it impossible for it to represent anyone who has business before the federal government.
