You’re putting too much stock in what you perceive to be a corrupt Supreme Court. The SCOTUS is there to oversee the laws have been applied correctly, not to write new law. Even if the SCOTUS disagrees with a lower court, it will remand the case there again, it won’t try it itself. Furthermore, the significance there will be to lower legal protections to law enforcement in general. That’s why I don’t think it’s ever going to happen.
History dictates the DOJ won’t bring a case they can’t win. This is because for career prosecutors, lost cases don’t make for promotion opportunities.

Chauvin spend almost ten minutes murdering George Floyd.
Chauvin was indicted and convicted of murder.
Byrd was cleared by his department and the DoJ.

Filing charges mean , all I said there’s not a judge in DC that will take it seriously. I also suspect there will be pushback from career prosecutors to bring the case forward to begin with, as there really isn’t a case here. These judges just handed over sentences to almost 1600 dumb people, I don’t really recall any acquittals, which is why most of these losers are waiting for a pardon.
