    A federal appeals court on Tuesday rejected the Trump administration's bid to pause a lower court's order that temporarily halted a massive freeze in federal funding.

    A judge in Rhode Island on Monday blocked the funding freeze and ordered the government to “immediately restore frozen funding.”

    In its ruling Tuesday, a three-judge panel for the 1st U.S. Circuit Court of Appeals wrote that the "defendants do not cite any authority in support of their administrative stay request or identify any harm related to a specific funding action or actions that they will face without their requested administrative stay."

    APOR stands for the “average prime offer rate,” and it’s a little tool that keeps the mortgage market running. It involves public servants, every week, going in and calculating it. Those staffers work at the CFPB, and if they’re locked out, you have no APOR tables. And over time, if you have no APOR tables, you have no mortgage market, or at least an uncertain and economically damaging mess.

    In the face of this, tough guy Vought blinked, and in so doing revealed why even the most John Galt-ian banker needs the government every now and again.
    Georgetown Law professor Adam Levitin explained the stakes in a post late Monday night. Lenders would either not make loans at risk of coming in above APOR, or would raise rates on loans below APOR to compensate, costing borrowers potentially tens of thousands of dollars in financing. Home values could get skewed, and credit access could be cut for many borrowers. “In other words, shutting down the CFPB does not reduce regulation. It actually increases it because it results in the [APOR tables] being miscalibrated,” Levitin wrote.

    U.S. District Judge Angel Kelley -- nominated to the bench by President Joe Biden -- issued a temporary restraining order that blocks the National Ins ute of Health from taking any steps to implement or enforce their rate change notice.


    Judge Kelley ordered the NIH to issue a status report within 24 hours – then at bi-weekly intervals – to confirm “the regular disbursement and obligation of federal financial assistance funds.”

    Colorado's governor and both of the state's U.S. senators asked the director of the federal budget office Monday to unlock what they said was more than $570 million in federal funds that remained inaccessible to state groups after a federal judge ordered the Trump administration to lift a sweeping funding freeze.

    In a letter, Gov. Jared Polis, and U.S. Sens. Michael Bennet and John Hickenlooper asked Office of Management and Budget Director Russell Vought to ensure that the funds are unfrozen, citing a federal court ruling that put a pause on the administration's freeze.

    "The consequences of this continued uncertainty are severe and could have a devastating effect on the programs and people this funding supports," the Democrats wrote. "Companies are considering staff furloughs. Employers in rural communities are rescinding job offers. Long-standing Colorado businesses, some with over 40 years of operation, now struggle to pay contractors working on facility expansions."
