    A Venezuelan national was arrested and detained by Immigration and Customs Enforcement agents earlier this month in Arizona, despite coming to the United States legally through an appointment on the CBP One App and having an active humanitarian parole status.


    "Everything was just going right until this happened,” the spouse of the person detained told ABC15. We’re not using her real name or the husband's name due to safety concerns for the family. "We have a social security number, have a driver license from Arizona.”



    After entering the country legally in 2023, the couple obtained legal do ents to work and filed for asylum. They started a family and have two young kids. The husband found a job and they were living the American dream.


    "He was working so hard to be the support for us,” the wife told ABC15. "I just want him to be back with us.”

The phrase “non-refoulement” might be unfamiliar, but the concept is simple enough—once someone has proved to our satisfaction that they are at risk of persecution or torture, we cannot put them back in the path of that persecution or torture. But that is precisely what canceling these flights does.

    US treaties are law of the land

    The standards for non-refoulement from the Refugee Convention and the Convention against Torture have both been integrated into US refugee law. Section 208(a) of the Immigration and Nationality Act provides for the granting of asylum under the terms specified in the Refugee Convention. Section 241(B)(3) of the same law further protects against the removal of someone who has not been granted asylum but shows that their “life or freedom would be threatened” because of certain characteristics if they were sent back to their country of origin. Courts in the United States have long held these laws to be reflective of the country’s treaty obligations and have applied the treaties in interpreting US asylum and refugee law.

    A naturalized Hispanic man says he was detained by Immigration and Customs Enforcement agents who were looking for another person on a deportation order, and now the man is questioning his vote for President Donald Trump.

    Jensy Machado said he is a U.S. citizen and provided News4 do entation of his legal status.

    Machado said he was driving to work Wednesday with two other men when he was stopped by ICE agents on Lomond Drive in Manassas, a short distance from his home. He said he was confused by what was happening, why agents surrounded the pickup truck.

    “And they just got out of the car with the guns in their hands and say, turn off the car, give me the keys, open the window, you know,” Machado told Telemundo 44’s Rosbelis Quinońez, who first reported his story. “Everything was really fast.”[/COLOR]

    He said the agents said the name of a man they were seeking for a deportation order, someone who had given Machado’s home address. Machado told them that wasn’t his name — he didn’t know anyone by that name — and offered to show them his real ID compliant Virginia driver’s license.

    “They didn’t ask me for any ID,” Machado said. “I was telling the officer, if I can give him ID, but he said just keep my hands up, not moving. After that, he told me to get out of the car and put the handcuffs on me. And then he went to me and said how did I get into this country and if I was waiting for a court date or if I have any case. And I told him I was an American citizen, and he looked at his other partner like, you know, smiling, like saying, can you believe this guy? Because he asked the other guy, ‘Do you believe him?’”

    Machado said he was uncuffed and immediately released after showing his driver’s license.

    The two men with him were taken into custody. He does not know why.

    Machado said the experience shook his faith in the immigration enforcement efforts of Trump, for whom he voted.
