    As an attorney I’m deeply alarmed by an incident that occurred just this week and feel compelled to share it—to raise awareness of the legal and cons utional crossroads we are rapidly approaching.

    A co-worker of mine (who is a judge), traveled by train from Montana to North Dakota for work this week. The train made a stop in Havre, MT, where ICE agents—armed and dressed in full military-style tactical gear—boarded the train.

    They walked the full length of the train and questioned every single passenger about their citizenship status. According to the conductor, who has worked nearly 40 years on that route, this was a first. In all his decades of service, federal agents have never boarded his train like this.

    This is not a hypothetical. This is not a scene from a dystopian film. This happened this week to my colleague, on U.S. soil, to U.S. citizens, legal residents, and foreign tourists here on holiday, without a warrant, without probable cause—based solely on geography.

    Under current law ICE has expanded authority to operate within 100 miles of any border. But HOW that authority is being interpreted and exercised has chilling implications for civil liberties, freedom of movement, and equal protection under the law.

    This isn’t about politics—it’s about the erosion of rights we’ve taken for granted, and the slow normalization of military-style policing tactics in everyday spaces. Even if technically permissible, these actions reflect a disturbing shift in the balance between civil liberties and governmental authority. The normalization of militarized immigration enforcement in public spaces, without individualized su ion, risks setting dangerous precedents that erode the freedoms we are sworn to uphold.

    This is not about ideology—it is about the integrity of our legal system. I am compelled to speak up because there is no justification for cir venting the very rights and principles that define our democracy.

    The question is not whether you “have something to hide.” The question is how much unchecked authority we’re willing to allow before we can no longer call this a free society.

    This is an unusual order for several reasons, suggesting the majority thought it necessary. This was issued:
    • after midnight
    • before the government even responded (perhaps most irregular)
    • while a Fifth Circuit request remains pending &
    • before a dissenting justice could finish their statement.

    threatened with deportation over some parking tickets and a fishing violation that got dismissed


    A Japanese doctorate student at Brigham Young University will now be able to stay in the U.S. after his visa was revoked earlier this month.

    BYU student Suguru Onda is a year away from finishing his doctorate. He’s married and has five kids who all live here in Utah.
    When he received word that his visa was revoked, the notice read “Individual identified in criminal records check and/or has had their VISA revoked.”

    Onda said he has no criminal history, just a few speeding tickets and a citation for a catch and release violation on a fishing trip with family six years ago.

    The cable references a “wish list” of policy concessions provided by Rwanda and a request for “a one-time payment of $100,000 to support social services, residency do ents, and work permits.” (A related note sent out today and reviewed by The Handbasket confirms the payment was made, but makes no further references to the wish list.) “Rwanda also agreed to accept another ten TCNs of various nationalities,” the cable states, adding the country “seeks a bilateral dialogue to develop a durable program to facilitate these relocations and avoid reinventing the wheel with time-intensive ad hoc negotiations.”

    “Rwanda's primary motivation for accepting Mr. Amen and subsequent TCNs [Third Country Nationals] is to improve U.S. relations and show it can advance the America First agenda,” the US embassy cable reads.

    There’s also a section of the cable called “press posture” that outlines how all parties involved should approach external questions about Ameen’s relocation. It includes these three bullets:


    • The United States makes no comment on any specific individuals.
    • Questions about removals can be directed to the Department of Homeland Security.
    • We do not speak on the deliberations or decisions of the Rwandan government.


    So far neither party has made a public statement about the relocation.
