NEVADA CITY, Calif. -- A 12-year-old girl was forced to take a pregnancy test at school in Nevada City, a lawsuit filed in Nevada County Superior Court alleges.
The Pacific Justice Ins ute, which is representing the girl, said in a news release that Steve Davis, a counselor at Seven Hills Middle School, pulled the girl out of class.
KCRA 3 has decided not to name the girl out of protection for her privacy.
Davis heard rumors that she was pregnant and wanted to know if it was true, the release said.
Though she denied it and told Davis a classmate had spread rumors about her in the past, the counselor got a pregnancy test from the school nurse and told the 12-year-old to give a urine sample, the Pacific Justice Ins ute said.
The pregnancy test was negative.
According to the news release, the girl was embarrassed and humiliated, and her parents were angry when they found out.
They worked with the Pacific Justice Ins ute to get an apology from the Nevada City School District, but didn't receive one.
The lawsuit, filed Oct. 29, 2008, seeks damages for violation of the girl's right to privacy and emotional distress.
"There is no merit in the claim," Superintendent Roger Steel said. He directed further questions to the district's attorney.
Reached at home Monday night, Davis said he had no comment on the lawsuit.

No merit?! If it was my girl I'd be PISSED! Just because some stupid kid said she was pregnant they did that? What bull . I would sue just to teach them a lesson. It isn't even about the money, it's that they don't see anything wrong with that.
My kids are being raised to respect adults no matter what. But I think that, in that particular situation, I'd feel perfectly comfortable advising my girl to tell that counselor to go himself. And frankly, I'd have his background investigated from every possible angle. No man is going to order my daughter to piss on anything without my becoming very su ious.
I can't believe the school nurse even gave him the pregnancy test, much less allow him to actually administer it!!
Pretty sad that a middle school clinic even has to have pregnancy tests in stock.
what was the purpose of the pregnancy test? If the girl turned out to be pregnant, then what? Does she have to wear a sign around her neck?
This is beyond stupid.
So, they're not allowed to dispense an ibuprofen at public schools, but they can administer a pregnancy test? I hope this school gets what's coming to them, because that is absolutely insane.

JISD will dispense Tylenol if you give them a note with the dosage your child is allowed to have. But a pregnancy test? WTF?
It's more than that. If this goes unchecked, not only can the school administer a pregnancy test, it can all but order any female student to take the test, even if the girl expressly denies that she's pregnant. If that's permissible, why not allow the school to mandate blood draws for drug testing whenever the principal thinks a student might be using drugs?
I realize that a lot of rights end at the schoolhouse door, but this sort of invasion is absurd.
It is sad, but I think they keep them for the sake of that one girl who might come in to confide in the school nurse, and be looking for some help.

I know this might not make sense but every time I read about a member of a school faculty doing something stupid like this, I always think that it's not the actual act that disappoints me, but the fact that they don't have the common sense to know better, I guess because it means that they could do a lot of other stupid things.

I don't think masturbation can make a girl pregnant, because her finger or fingers, or something else she chocks into her virgina can never give out any realistic cells that may have some work on the eggs.
