Religion should not dictate our laws, and that is that, if you don't agree with that then get out of this country, because none of the founding fathers wanted that and they knew why. So, any politician who tries using religion to justify their own personal hatred (towards gays for example) should just resign and do something else where they aren't affecting the lives of millions over their stupid beliefs.

I don't care about the anaylsis of how religon is good or bad for laws in a country. My point is that even today you can see religon having an influence on laws and that's that.

The 10 C's mention that you are to have no other god than the one true god. They also mention false idols. And so on, and so on.
Hammurabi's Code has no mention of this. All of the laws he passed were laws to ensure that people lived moral lives.

Also, if we are talking about morality, Hammurabi's codes are immoral compared to todays' standards, so if morality is the case, then you can exclude Hammurabi and his laws from this.
If we can accept that Moses said that the 10 C's were ordained by God and those laws have a religous background to them, then we can say the same for Hammurabi.
