Kevin Willis did the same thing in a playoff game when he played for the Spurs. He got ejected, and suspended for a game. That was an intentional elbow above the shoulders. They have to suspend him for a game, or totally ignore the rules.

Kobe did elbow Artest in the throat. It was exactly the same move he's used so many times before, and gotten suspended for a couple of times. Artest will take the worst of it because he's Artest, and because he didn't leave the floor quickly enough.
