Amazing that the immediate benefit of the doubt goes to the state. What a docile, spineless people who inhabit this country.

The other day Cobra Commander thought the pioneers of the good ol' lilly white Westward Expansion days would laugh at modern day liberals. I think they'd be scared of modern (so-called) conservatives like the Commander who worship the state.

white people are probably more inclined to trust the state than minorities are to begin with.

This is a perfect example of why conservatism is headed towards permanent electoral loser status. It may shock the Yannis and Water Closets of the world but non-white citizens tend just as much as white ones to be conservative. The difference is that the Cobra Commanders and Plagiarizers who think they are libertarian minded conservatives end up turning political conservatism into an authoritarian movement with a thinly disguised disdain for non-whites.

Jefferson thought spilling a little blood once in a while in revolution against the state was good for liberty. Cobra Commander would think that means that every day cops should pick up black men off the street and execute them.

Put down the thesaurus and stop being such a drama queen. By the way, you're painting with a pretty wide racist brush.

Oh really? Now throughout the country people are discussing the role of the state and its abuses. The good professor's resistance will only help those people.

I do not understand how people immediately identify with the state and assume that a fellow citizen was in the wrong. This goes to show you that public education is serving its purpose.

God forbid the police should let us alone in our own homes, once they verify that we belong there, and that there is no criminal activity that warrants further investigation.

Instead they detained Gates for just being a , and so-called board conservatives applaud. I guess the 1st amendment goes out the window when a cop is addressing you.

He left the house and Gates continued to a public setting and became a disturbance in a public area.

Heres a quick and dirty explanation of what disturbing the peace entails. You tell me if yelling at people in your yard counts.

LOL at Darrin's references to Obama as a communist, fascist, dictator, and socialist from the past year.

That you seem to think so reflects either poor reading or dishonesty.

What I said contained no hyperbole. You're the only one calling Cambridge PD stormtroopers or the Cambridge city jail a labor camp.

You mean his own front yard, right?

Heres a quick and dirty explanation of what disturbing the peace entails. You tell me if yelling at people in your yard counts.
If no one complains, and the shouter is no threat to himself or (numerous) LE on the scene, police should use their discretion.

That the charges were dismissed may indicate that the basis for the arrest was pretty weak to begin with.

At any rate, Cambridge PD prefers not to take their chances in court, but just wants it to go away.

Sounds to me like the arresting officers made the wrong call on this one.

There... Navigate to the Public Peace, Morals and Welfar section, then find the Offenses against Public Peace and Decency...

    It reads:

9.08.010 Disorderly conduct--Profanity and insulting language.
No person shall behave himself in a rude or disorderly manner, or use any indecent, profane or insulting language in any street or public place. No person shall make or cause to be made, any unnecessary noise or noises in any public street, private way or park, so as to cause any inconvenience or discomfort for the inhabitants of the City.

    (Prior code § 13-5)

I think that Gates' actions as expressed in the police report fall under that regulation... His yard is a public place, before you try to use that arguement...

It's amusing how a full half-year plus of whining in this forum by self-described "conservatives" about the fascist state set to descend on this country disappeared when this issue came up.

the officer asked him to step outside, he did and he was arrested, since you cant get arrested for being disorderly in your own house

I also emphasized the lack of discretion, sam.

Even if the arrest was justifiable, it shows poor discretion to arrest a man at his own residence for being a bit of a about a mistaken police investigation, based on an erroneous complaint.

According to the police report, which is the only official do ent, Gates followed him outside, no one forced him to leave his house. If he had never gone outside, this whole situation would have never happened.
