I do not understand how people immediately identify with the state and assume that a fellow citizen was in the wrong. This goes to show you that public education is serving its purpose.
God forbid the police should let us alone in our own homes, once they verify that we belong there, and that there is no criminal activity that warrants further investigation.

He left the house and Gates continued to a public setting and became a disturbance in a public area.

If no one complains, and the shouter is no threat to himself or (numerous) LE on the scene, police should use their discretion.
That the charges were dismissed may indicate that the basis for the arrest was pretty weak to begin with.
At any rate, Cambridge PD prefers not to take their chances in court, but just wants it to go away.

I think that Gates' actions as expressed in the police report fall under that regulation... His yard is a public place, before you try to use that arguement...

Even if the arrest was justifiable, it shows poor discretion to arrest a man at his own residence for being a bit of a about a mistaken police investigation, based on an erroneous complaint.
According to the police report, which is the only official do ent, Gates followed him outside, no one forced him to leave his house. If he had never gone outside, this whole situation would have never happened.
