    Rep. Conyers Discovers New Clause In Cons ution, More Than 200 Years Later

    One of the more controversial – and uncons utional – components of health care reform President Barack Obama signed into law yesterday is Congress’ mandate that individuals purchase health insurance or face a fine.

    The Heritage Foundation has do ented that there is no provision in the Cons ution empowering Congress to force Americans to buy a good or service. What’s more, the nonpartisan Congressional Budget Office agrees the mandate is entirely unprecedented.

    So where does Congress get the authority to justify that provision? On Friday, CNSNews.com went to House Judiciary Committee Chairman Rep. John Conyers (D-MI) for answers:


    CNSNEWS: “What part of the Cons ution do you think gives Congress the authority to mandate individuals to purchase health insurance?”

    Rep. Conyers: “Under several clauses. The good and welfare clause, and a couple others.”

    The “Good and Welfare” clause simply doesn’t exist. It’s nowhere to be found in the Cons ution. CNSNews.com reports:

    The word “good” only appears once in the Cons ution, in Article 3, Section 1, which deals with the Judicial Branch, not the powers of Congress. Article 3, Section 1 says in part: “The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior, and shall, at stated Times, receive for their Services a Compensation which shall not be diminished during their Continuance in Office.”

    As an aside, Rep. Conyers has a law degree, and his committee is responsible for overseeing the federal court system, which in turn interprets and applies the law of the land.

    he probably meant the "provide for the general welfare" clause
    That must be it along with "Shred the blessings of liberty."

    but when it's about declaring war on terra -- blast that 250 year old artifact
    I suggest you read the 2002 Authorization for Use of Military Force in Iraq.

    Congress gave President Bush the authority to do what he did and, contrary to all the gnashing of teeth, over the years, Congress never rescinded that authority or defunded any military action ordered by President Bush.

    i recall Republicans making fun of Ron Paul for proposing that Congress actually declare war against Iraq

    Well, i don't recall what you mean, but considering he was against the war, but asked for it to be authorized by congress is laughable.

    Will you please show me where it says in the cons ution to "declare war" is strictly up to congress?

    it hardly matters which. This is what the US Cons ution says about the privilege:

    shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.

    But WH, that means the PRIVILEGE shall not be suspended! Which means... uhm.. splutter, sputter, twisted nutter...

    And don't bother reading up on any precedence that courts have created either.

    You want some funny reading material, look up and read about Rep. Conyers wife and former head of Detroit City Council, Monica Conyers, who was recently sentenced to 36 months in prison.
