Good point and I thought the same thing. And if it is used in the movie from whom did they obtain it? If from the TV station then I think TP is in the clear, regardless of how she feels about the footage. If I not mistaken if the footage was given by her father to the TV station and said station gives prermission for TP to use it then case closed.
The weak link here is the father IMHO. He's the one that is responsible for the footage getting out and into other people's hands.
Did anybody else catch that? That Tony was already pretending to play for the Spurs?

I saw his movie this week and there were short sequences from when he was little and i think i saw him wearing spurs related clothes, at least it looked like that. I could be wrong.

the woman's father is not using it, Tony is. However, he might have been led to believe he had permission to use it, making his use of it reasonable. If he produced stuff relying on the fact that her father had permission to give him permission, he might have a good defense. It raises the question of whether a 3rd party who appears to have authority to consent can relieve some or all liability. This is a question of french law.
Here, she could get something like the profits proportional to the impact that her piece of footage had for the product. So if the footage was 1% of the film, but was really important to the film, damages would go from there. I don't know what you get when it is not for profit, like for marketing. They would want some very hard to prove percentage of tony's general marketing sales. That would be a really hard case to prove, lots of experts.
I'm not sure what you are talking about. There's been nothing said that Tony was using the footage for anything. Just that her father had given it to TV stations, etc without her permission. No one has said that Tony used the footage in his film.

One would assume that the producers got a release for any footage they used in the movie that they did not create themselves. If not, they have only themselves to blame, and she probably has a good case. This is basic to the business of producing commercial images/videos. You don't "assume" you have permission.
It's somewhat unclear from the news stories who is the producer/owner of the film and whether that person is, or has business ties to, Tony Parker. It's also unclear whether they got a release from the father, and the daughter is claiming he was not the rightful owner, or whether the daughter is just suing because they used the footage without authorization of any kind.
Its unclear indeed of the footage was used for the movie and nothing is said about the movie, I think if it was then something would have been mentioned about the movie in the report. On the other hand, the movie was made or supported and aired by canal + and canal + is mentioned in the report, so maybe they are hinting at the movie.
But its irrelevant really wether its about the movie or not. Tony Parker didnt do anything wrong here. I mean the footage was given of her family to tp's family and the footage is of tony parker himself, so he has the right to use it especially if it has been given to his family. I dont know the exactl laws in France about this, but I dont think its illegal.
That said, this woman is probably just trying to cash in on TP's wealth at his expense, she sees this as a chance. There are alot of crazy f*cked up people in the world getting brutal when they see someone close or closer to them is having a lot of money.
