you have a right to be free from assault on the street too, but sometimes happens. The state is charged with custody and care, but theres only so much you can do when two grown folks want to go at it.

I love the premise behind the OP. If you are a child molester, legally, you should be allowed to be beaten up with no legal recourse.
Not saying I support child molesters or anything, but not saying they lose all rights as soon as they're found guilty, either.

If govt officials have reason to know of some danger they have to prevent it. But if the attack is out of the blue, what can you do? There is no such thing as 24-7 surveillance of every person in prison. With patience and sealed lips, anyone can be had in prison. Including security.

convicted crimes aren't publicized to inmates. But some chesters just tend to stand out in a crowd I guess...
And many of the ones that might otherwise stand out as pedophiles will also draw attention as potential victims to other predatory inmates
I think we all agree that he may DESERVE to die, but it doesn't mean we should make it legal for prisoners to beat him up, or that he shouldn't have legal recourse to the system.

Sure, but if you try to protect all the molesters in the system from the non, you'll cripple the system. Its just not that easy to draw lines in the population.

there's probably some missing info like the guards being informed a week earlier about the attack and doing nothing to prevent it, or the guards leaking info about the convict's charge to one of the gangs.

quite honestly there had to be some other negligence involved. I have personally seen inmates get stabbed and beaten, but I haven't heard of very many of these multi-million dollar judgments resulting. I have had co-workers and family members investigated for excessive uses of force and other complaints, but have never known one to pay out. Maybe that explains the status quo, at least here in Texas. My Dad testified in a wrongful death case where an inmate got shanked on the wreck yard, and he failed to administer CPR because the guy was excreting blood and bile out of his mouth, and nothing ever came of it.
I'm just saying.
There is no legal std that demands that chesters get special protection in jail. They get the same protections as any other member of the population. If the state becomes aware of a threat, they have a duty to step in. Until then, the inmate is vulnerable.

But, in that case, I would be suprised if those reports could be confirmed/implemented in a few hours. To make it from the Warden's office/agency official down to the actual housing unit takes an eternity. But this was probably the justification for the award, Im sure.
