Sure.
If someone feels threatened enough to report you, then the cops will show up and question you from a safe distance. It is still considered a deadly weapon so if you try to throw it or threaten to throw it they could justifiably shoot you.

Thanks for the nice intro...
Dude must have been really, and I mean, really hammered.
If I see a bunch of cops show up at my house with their lights on and officers getting out and behind cover, looking in my direction, I'm not going to do a damn thing except drop whatever I'm holding and raise my arms as high as I can. I'm all for civil rights, but I'm not going to get myself killed just to make a point.
Sounds like a bad situation all the way around. Could have been handled better by the police, who should have realized that he's not firing back after the first couple of rounds, and definitely could have been handled differently by the drunken guy. I seriously wonder what his mindset was when a bunch of cops showed up. "If they don't get off my property, they're getting the hose!"
I doubt they would have charged him with anything if he would have dropped the "gun" and then they realized what was going on. Even if they did, he probably gets off with D&D or public disturbance, at worst. Sad situation.
"Position of cover" does not mean 100% safe from would be gunners bullets?
They also do not know if other re s with guns are accompanying intoxicated porch with "six-shooter"?
I'm just saying. How much time and precaution did they have? Supposing porch was holding (as 911 caller said) a six shooter while being intoxicated?
Two officers responded to a 911 call at 4:40 p.m. Sunday from a neighbor reporting an intoxicated man holding a "six-shooter".
AGAIN.....15 FREAKING SHOTS??? If they were close enough to be in harms way then they must've been close to see the guy hit the deck after the first two or three shots. I can't help thinking of Tom Cruise in the movie "TAPS" when he's in a building shooting from a window shouting, "It's beautiful!!". Huh, I guess the cops were trigger happy!
^^ 4-5 cops from different angles all shooting 2-3 shots?
Or less cops but with rapid fire guns that blow out 5 bullets for each 0.000025 seconds trigger held?
Q. Suppose porch did have a real gun, was saused up, and the cops held back thus he did fire shots that killed two little kids living behind where the cops cars were parked. Now what about Porch s rights?
