First, the law doesn't work on a preventive basis. It only works on a punishment basis. Otherwise lots of TRO deaths would never have happened, lots of abused kids would not be abused, all that.
For some reason this dogma exists that there is absolute in-culpability for things posted online, as if the internet is a role playing game. Little by little they are discovering that it's real life and you can be arrested for your actions here too.
The guy broke the law. He probably wasn't aware of it, but that's never been a good excuse (never accepted as one). Had he known he was breaking laws, he probably would not have posted it.
He's a moron, plain and simple, and he didn't care that millions of people would see that classroom full of kids and what he was appearing to say in their presence.
Makes you wonder how people like that ever expect to get a decent job.
Also, it has nothing to do with parents wanting to wreck his life. In these cases the state undoubtedly files charges. It might even be federal in this case. If so he's screwed. The parents couldn't just have him arrested over outrage. They could sue in a civil court, but he's facing criminal charges. Crimes against kids are pretty hard to defend. There are a few child sex offenders living in my neighborhood, a couple were 18 and dating a 15 year old. They got married later, but still have that charge.

If you consider that they could be very literal with the law and arrest everyone, or just publicize one person being arrested for it and see how it works, it's actually more liberal than the alternative.

However you spin it, the law is ed up on this decision. A harmless prank that ends up offending some parents. All the guy did was cuss. The kids didn't even see him cuss. It's ing ridiculous and you should know that if you have a brain. This isn't the Soviet Union. Freedom of Speech should be allowed.

The guy broke laws. The authority having jurisdiction in this case isn't the parents. It's like saying an assault victim was the one who caused the offender to be prosecuted. The guy broke the law, plain and simple. The parents don't have strings to the court that allow them to make these things happen.
Stop shouting out the Bill of Rights when you obviously have no idea what they mean. Freedom of speech isn't a shield against responsibility for your actions. You cannot stand up in a crowded theater and yell "fire!" for example. Slander is another example where your "freedom" invades mine. Freedoms do not enable you to violate other people's freedoms. Even the 2nd Amendment has limitations. I cannot carry a handgun legally into a public school. That doesn't violate my 2nd Amendment right to keep and bear arms.
If anyone knows how to interpret the BoR, it would be the courts. If this court gets it wrong, the next one will have a go and maybe up to the USSC if they want to hear it.

I'm all for protecting the children, but paranoid s who get carried away and demand this sort of are a hundred times more dangerous than a dumb kid with an awful sense of humor and poor judgment.
Talk to the judge, the prosecuting attorney, the DA's office, maybe a few more.
It's not about deserving. It's about the law. If he doesn't deserve it, he won't get it. You guys are defending someone who did something you find funny, something you might do yourself if you had the ability, so you are in essence defending your own.
20 years? No. No one even gets that for child molestation. He will get a pretty good fine and not be allowed into a public school or even near it for quite some time, and may be registered as a child sex offender.
The catch might be that there were several kids, so it could be compounded.
I don't find it funny, but I still don't think the punishment fits the "crime." The guy is essentially facing 20 years (not saying he'll get it) and being forced to register as a sex offender because of some video editing.

I want to ask a question. Can he be charged with, say 20 counts of slander ( or one for each of the kids in this video however many there are). I don't know how that would shake out punishment-wise, but wouldn't this seem to be the more appropriate charge? I wouldn't want him to get a sex-crimes conviction on his record for this, but I do think he should be punished.
