    ARTICLE XIII. MISCELLANEOUS PROVISIONS:

    SECTION 12. [Recall of elective officers.] The qualified electors of the state of any congressional, judicial or legislative district or of a county may pe ion for the recall of any in bent elective officer after the first year of the term for which the in bent was elected, by filing a pe ion with the filing officer with whom the nomination pe ion to the office in the primary is filed, demanding the recall of the in bent.
    (1) The recall pe ion shall be signed by electors equalling at least twenty-five percent of the vote cast for the office of governor at the last preceding election, in the state, county or district which the in bent represents.
    (2) The filing officer with whom the recall pe ion is filed shall call a recall election for the Tuesday of the 6th week after the date of filing the pe ion or, if that Tuesday is a legal holiday, on the first day after that Tuesday which is not a legal holiday.
    (3) The in bent shall continue to perform the duties of the office until the recall election results are officially declared.
    (4) Unless the in bent declines within l0 days after the filing of the pe ion, the in bent shall without filing be deemed to have filed for the recall election. Other candidates may file for the office in the manner provided by law for special elections. For the purpose of conducting elections under this section:
    (a) When more than 2 persons compete for a nonpartisan office,a recall primary shall be held. The 2 persons receiving the highest number of votes in the recall primary shall be the 2 candidates in the recall election, except that if any candidate receives a majority of the total number of votes cast in the recall primary, that candidate shall assume the office for the remainder of the term and a recall election shall not be held.
    (b) For any partisan office, a recall primary shall be held for each political party which is by law en led to a separate ballot and from which more than one candidate competes for the party's nomination in the recall election. The person receiving the highest number of votes in the recall primary for each political party shall be that party's candidate in the recall election. Independent candidates and candidates representing political parties not en led by law to a separate ballot shall be shown on the ballot for the recall election only.
    (c) When a recall primary is required, the date specified under sub. (2) shall be the date of the recall primary and the recall election shall be held on the Tuesday of the 4th week after the recall primary or, if that Tuesday is a legal holiday, on the first day after that Tuesday which is not a legal holiday.
    (5) The person who receives the highest number of votes in the recall election shall be elected for the remainder of the term.
    (6) After one such pe ion and recall election, no further recall pe ion shall be filed against the same officer during the term for which he was elected. (7) This section shall be self-executing and mandatory. Laws may beenacted to facilitate its operation but no law shall be enacted to hamper, restrict or impair the right of recall.

    verify that the recall pe ion circulated by The Committee to Recall Rick Snyder (FireRickSnyder.org) is valid even though Snyder is less than 180 days into his term.

    Short answer: yes. Long answer: yes.

    Here is a summary of the information I received during a call with the Elections Division of the Michigan Secretary of State's office:

    1. Can a recall pe ion of a statewide official be approved less than 180 days into that official's term?
    Yes.

    2. Can such a recall pe ion, once approved, be circulated less than 180 days into the relevant official's term?
    Yes, as long as the signatures are submitted after 180 days had expired.

    3. Which county must approve the pe ion?
    The pe ion must be approved in the county where the official resides, which in this case is Washtenaw. As it happens, this is where The Committee to Recall Rick Snyder had their pe ion approved. Literally dozens of news stories reported on Washtenaw County approving the pe ion. For example, CBS Detroit:

    A recall pe ion effort to oust Republican Governor Rick Snyder has cleared a hurdle, and can begin collecting signatures aimed at getting the measure on the ballot, unless the governor files an appeal.

    The Washtenaw County Board of Election Commissioners voted 2-1 the pe ion language, which says Snyder should be recalled for supporting sweeping new powers for emergency managers, including the ability to void labor agreements.

    The deadline to appeal the pe ion passed without Snyder filing one.

    Some final details:

    The recall pe ion is valid for 180 days in total, and 90 days from when the first signatures are gathered.
    Signatures began to be gathered on Saturday, May 21, which means the signatures must be filed before August 20.
    In order for the recall vote to be on the ballot in November, recall organizers believe they need to submit the signatures before August 5.

    Upon arrival, members of the recall committee were encircled by union protesters carrying signs and a leader with a mega phone who began chanting and ranting loudly. They packed in tightly around the pe ion collection table so as to prevent those attempting to sign from doing so. At one point, a pro union protester, pretending to be interested in signing the pe ion, wrote profanity across a partially collected pe ion form, than began ripping up the completed pe ions that were in close proximity.

    The policemen who were there, and who were standing in close proximity to these events as they unfolded, did nothing to assist those collecting the pe ions as they were being destroyed, despite such an action being a Felony under Wisconsin law. Police also did nothing to clear the walk way for citizens that wanted to sign the pe ions. Recall Committee members received many phone calls the following day from Merill area citizens who stated that they showed up to sign the pe ion, but were too afraid to get out of their vehicles and approach the recall table.

    Are Democrats in Wisconsin so desperate they would resort to breaking the law to prevent a recall election?

    That's the impression one gets from an article posted Saturday at WTAQ's web site.

    According to WTAQ, Green Bay police are investigating a report of a burglary at an office used by an organization working to recall Democratic State Senator Dave Hansen.

    Hansen was one of the 14 who fled Wisconsin to prevent a vote on Governor Walker's budget repair bill.

    WTAQ reports the break-in "most likely happened" sometime between 5 pm Thursday afternoon and 8 am Friday morning.

    David Vander Leest, organizer for the group seeking the recall of Hansen, said in an email that "pe ions, t-shirts and a computer" were stolen.

    Vander Leest blames the burglary on the "opposition of Recall Dave Hansen," according to WTAQ.

    WBAY reported that the organization said it had enough signatures to start the recall election on Friday, and were preparing to deliver them to the State.

    WBAY reported:

    The groups targeting the Democratic state senator are planning a victory party Saturday. Then they say they'll double-check their pe ions before handing them over to the State.

    Once that's done, the Government Accountability Board will determine whether enough signatures are valid to trigger a recall election.

    According to WTAQ, Vander Leest said he started the effort because he was “irritated that they were making heroes out of Senators leaving the state and going AWOL.”

    But the battle over the legitimacy of voter IDs is significant in Wisconsin. It’s historically been a swing state that’s had high levels of voter engagement, particularly among young voters and those of color. Back in November, I reported from Milwaukee that the state’s powerful crop of young black voters were busy forging their own political paths. The latest Census numbers showed that black youth had the highest turnout among voters of any ethnic group aged 18-24, and nearly two million more voted in 2008 than in 2004. Wisconsin was among the highest youth voter turnouts in the country.

    Many people are worried that that sort of consistent voter turnout is in jeopardy because the new voter ID laws will make it too costly to go to the polls. “What it does is it puts the onus on the citizens to do all this legwork, when really voting is a right put into the Cons ution,” Marcelo said. And that legwork, he says, doesn’t stop at the price of getting a new ID, which can range in price up to $50. It also requires people to take time off of work or school to stand in line at their local DMV, and the price may increase if a person needs supporting do ents, like a birth certificate. The Legislative Fiscal Bureau estimates that if the bill becomes law, it could cost more than $5.7 million to implement, according to the Journal.

    Only 25 percent of African Americans and 34 percent of Latinos in Milwaukee County have valid licences, compared to 71 percent of young white adults elsewhere in the state, according to a 2005 report from the Employment and Training Ins ute at the University of Wisconsin Milwaukee.
