Failing a field sobriety test means nothing. I had an idiot cop tell me I failed and when I did the breathalyzer I blew .00. He was going to arrest me for a DUI based on the field sobriety test and said the breathalyzer was my last chance to avoid arrest. He then claimed I must have naturally occurring eye nystagmus that only 5% of the population have. I think he was just very inexperienced and didn't know what he was doing. I so wanted to laugh in his face at his stupidity but I quietly left the scene without even a ticket for the illegal turn.
The scary thing is they can arrest you even if you are well below the legal limit in your state and fully capable of safely driving if they find any alcohol in your system. They just have to claim that they feel alcohol impaired you. Of course you'd likely get the charge dismissed if you are under the legal limit but there is a lot of bull in how DUI sobriety tests are administered and how they enforce the laws.

Well, since she's under the legal age (I believe), and alcohol in her system would be over the limit.
