Police received reports of tear gas being dispersed in the theater; they donned their gas masks in preparation of entering the theater and, whey they encounter Holmes, outside the theater, near his car, they took them off and dropped them on the ground while taking him into custody.

To preserve the crime scene -- everything was left where it lay.

Seeing gas being thrown from a different direction could just as easily be explained by a canister ricocheting off a wall and not being seen by the witness until it had changed directions.

You know that red hair would have stood out to me if he was sitting around me, or next to me, in fact sitting ANYWHERE in a BATMAN sold out 12am screening, ANYONE would have seen that when he walked out.
