As far as I know, they make sure they stay a certain distance from the funeral, and make sure to obey all city ordnances. *shrug*
If there is no fire, you can be prosecuted. There is a court case around it.
What court case?
How in that case did shouting fire incite violence or lawlessness?

It's not important enough for me to find for you. If you aren't aware of such case precedent, then I don't care. Just don't claim I'm wrong without finding a case to show that.

There was a USSC case regarding the drafting and mailing of letters to military draftees that encouraged them to resist. The person who mailed them was charged and the case made it to the USSC. The decision was that the conviction was cons utional because it was at a time of war and the freedom of speech did not cover saying things detrimental to the war effort. During that decision the example "shouting fire in a crowded theater" was used, indicating that it is not a true exercising of the 1st Amendment to falsely shout "fire" in a crowded theater in order to incite mayhem.
I don't know of anyone who's been arrested for actually shouting fire in a crowded theater, however I was in a theater when some Mexican in the back yelled out, before the movie "he's got a gun!" and there was a moment of panic. The Mexican was taken away by police officers after some questioning of the movie goers. This was long before the Aurora shooting. I have no idea what happened to the guy or if any charges were filed.
Would he really have been prosecuted had he really thought he had seen a gun?

I just have better things to do with my time. I've seen it, I know its there. maybe someone else will find it for you if you aren't willing to take the tame. Just search for why you cant yell fire in a theater.
Who has time to post the same arguments at least 20 times a day on different threads, but no time to look up anything to back up said arguments?
