    I guess you had the same bother with blacks fighting for their rights to vote, etc?

    This will go up to the Fifth Circuit and will likely be reversed there.

    The real question is what SCOTUS does with this issue. As the number of states who permit same-sex marriage increases, we reach a point where allowing state-by-state regulation of those relationships becomes a practical impossibility in a portable society; that would suggest that there should be a universal governing principle on the legality of same-sex marriage and I tend to think that principle will find bans on same-sex marriage to be uncons utional. The basic practical arguments for bans have always been pretty shallow and courts are finding a number of ways to conclude that the bans fail as a matter of cons utional law.

    I'm not sure why anyone is choosing to devote time and money to fighting this battle -- since the outcome now seems a fait accompli -- but obviously, it will continue until there's a definitive ruling on the cons utional issues.

    Maybe in some places but we'll see in Texas.

    Should be interesting to see how AG and candidate-for-Governor Greg Abbott handles. Everyone expects him to appeal, but he could take a lot of wind out of Wendy Davis' sails if he doesn't. His base will still show up and vote for him regardless. Davis needs energized urban voters to rally for her, and this would be one less issue for them to rally around.

    I mean, it's only a winner on states that are already decidedly red. Everywhere else, it's a political loser.

    A closely watched case currently before the Supreme Court, Sebelius v. Hobby Lobby Stores Inc., has nothing to do with LGBT rights, but everything to do with religious freedom. At issue is whether the federal government can require private businesses to cover birth control for their employees under Obamacare if the employer objects to contraception on religious grounds.

    That's why advocates and legal experts say that if the justices rule that the health care reform law doesn't apply to those individuals and businesses, their legal reasoning could open the door for more discriminatory legislation. Or if they rule that it does, that could establish a new judicial foundation for striking down those anti-gay laws.

    His rhetoric in the immediate aftermath of the decision today was a written statement insisting that an appeal is coming. I wonder to what extent that decision is being driven by Abbott (who has a history of using state resources to pursue extended litigation on hot-button issues) or by Governor Perry (who might see victory on this issue as a significant point to his legacy).

    I'd frankly be stunned if the State didn't appeal.
