    Darren Erman secretly taped talks

When Golden State Warriors assistant coach Darren Erman was fired earlier this month, the reason given was a "violation of company policy."
It turns out that Erman's violation was secretly recording conversations between the team's coaches and players, according to sources with knowledge of the situation.

Sources said Erman, who was coach Mark Jackson's second assistant, would record coaches' meetings, meetings between the coaches and players, and informal discussions among coaches that took place in the team's coaches room -- all without the participants' knowledge.
"He was taping everything," one source said. "Taping pregame speeches wouldn't have been that bad, but he was taping guys just sitting around talking in the coaches' office."
Sometimes Erman would be present during the tapings. Other times, he would leave the room and leave his phone behind to record conversations the other coaches were having.

    ......

So now taping private talks is a no no...

Erman's dismissal was the second bizarre event involving Jackson's staff in less than two weeks. On March 25, management demoted first-year assistant Brian Scalabrine to the club's D-League affiliate in Santa Cruz.

Sources say the team made the move because Scalabrine exhibited a consistent pattern of disrespect toward Jackson and the other coaches. Mainly, he ignored and refused to speak with the other basketball coaches. At one point, Scalabrine went five weeks without speaking to Jackson, one source said.

Scalabrine even avoided the coaches on the team plane, sitting in a separate section, according to one source.

It should, but the results in the NBA have precedence now... anyone on the tape saying anything racist, biased or mean spirited can and will be called out on it and possibly fined by the league. You have to wonder what's on those tapes, and how many people are now going to record conversations with upper management and even head coaches just to have a fall back in case something happens.

IIRC, it's illegal to secretly record convos in Cali, except when both parties agree to the recording. Apparently, the latter is what happened with Sterling. So this would actually be a different situation.

Warriors owner should be banned for life also. Scalabrine is gingerhead.

I wonder how much of the recordings are cliched coach-isms and catch phrases. Probably mix in some calls to the local strip club when Mark's done praying tbh.

But if leaked to the press, the results would be the same.

I'm not sold on that. IMO, the commish would be much more agreeable to wait if there's criminal conduct involved.

Waiting is fine, but what if Mark Cuban was recorded calling Blair a stupid porch monkey? He'd be forced out. You cannot say it was all because of the legality of the recording. It was what was said, the fact that Sterling exposed himself as a racist.

Mel's rant wasn't legally recorded either, but now he's labeled as a racist.

I agree that there's a business side that weights heavily into this too. But I think you're underestimating the commish.

This is speculation, but I'll be willing to bet he gave Sterling an out through specific actions (heartfelt public apology, donations, etc), but Sterling is too into his to do that.

It's like when Kirby was caught saying " got"... a fine, a suspension, a PR campaign to undo the damage, and as long as the participant is willing to do it, you can make amends. I just don't think Sterling was amicable to that.

I'm not talking about how the NBA would respond. I am talking about people deciding to record other people and it becoming a tool to leverage people into or out of positions. The reason the dude in the OP was fired was probably because it was thought he was trying to take information to his next job, but trust is a huge factor in a working relationship. If players say these things on the court, imagine what they say in private. s everywhere will be foaming at the mouth to get anything and the league has to respond in some manner, especially if it's a racist remark.

This is just the beginning. People will be digging for gold for quite some time now.

I'm actually surprised he wasn't sued and he's allowed back in the league. What you describe amounts to blackmailing, which I think would be considered in a different light. Just my opinion.

It's only blackmail if you demand a ransom else you release it. If you just sell it to TMZ so they can turn it into another media circus, that's a gold mine. Legal or not, it will be compared with the Sterling incident. The general population hasn't been concerned with the legality of sensational stories... and evidence of that is that they went ballistic over the Zimmerman thing without regard to legality. That's the same people who buy NBA merchandise and sway the advertising execs to spend here or there. That would indeed cause the league to make a move.

I have seen zero proof or heard zero recordings at this point that point to Sterling giving permission to be recorded. Did anyone have a credible source/recording that proves that?

The "court of public opinion" can be swayed, given time, actions and PR spin. But as I said earlier, there has to be full commitment to it from all parts.

If there's not, and the league feels damage has been done to the business and there's no good faith in making up for it, then I can see why the league might want to part ways.

There's infinite ways to spin stuff like this and work your way out of it, but if the person is uncooperative, then it's a problem.

I don't see any way out of what he said. He couldn't have meant anything else by it other than what he said. I didn't find it particularly racist, I found it more of an acceptance of racism if anything.

I guess we'll find out soon enough. I'm fairly certain Sterling has a solid case if he was indeed recorded without his consent.

I think Silver mentioned he didn't care that it was private and that it "wasn't private now" in making his decision. The fact that Sterling confirmed it was his voice is what Silver considered since it was now public knowledge.
