    Washington, DC – Today, Ways and Means Committee Chairman Dave Camp (R-MI) issued the following statement regarding the Internal Revenue Service informing the Committee that they have lost Lois Lerner emails from a period of January 2009 – April 2011. Due to a supposed computer crash, the agency only has Lerner emails to and from other IRS employees during this time frame. The IRS claims it cannot produce emails written only to or from Lerner and outside agencies or groups, such as the White House, Treasury, Department of Justice, FEC, or Democrat offices.

    “The fact that I am just learning about this, over a year into the investigation, is completely unacceptable and now calls into question the credibility of the IRS’s response to Congressional inquiries. There needs to be an immediate investigation and forensic audit by Department of Justice as well as the Inspector General.

    “Just a short time ago, Commissioner Koskinen promised to produce all Lerner do ents. It appears now that was an empty promise. Frankly, these are the critical years of the targeting of conservative groups that could explain who knew what when, and what, if any, coordination there was between agencies. Instead, because of this loss of do ents, we are conveniently left to believe that Lois Lerner acted alone. This failure of the IRS requires the White House, which promised to get to the bottom of this, to do an Administration-wide search and production of any emails to or from Lois Lerner. The Administration has repeatedly referred us back to the IRS for production of materials. It is clear that is wholly insufficient when it comes to determining the full scope of the violation of taxpayer rights.”

    It’s not just Lois Lerner’s e-mails. The Internal Revenue Service says it can’t produce e-mails from six more employees involved in the targeting of conservative groups, according to two Republicans investigating the scandal.
    The IRS told Ways and Means chairman Dave Camp and subcommittee chairman Charles Boustany that computer crashes resulted in additional lost e-mails, including from Nikole Flax, the chief of staff to former IRS commissioner Steven Miller, who was fired in the wake of the targeting scandal.
    The revelation about Lerner’s e-mails rekindled the scandal and today’s news has further inflamed Republicans. Camp and Boustany are now demanding a special prosecutor to investigate “every angle” of the targeting. They expressed particular outrage that the agency has known since February that it would not be able to produce the e-mails requested by the committee yet did not apprise the committee of that fact, and they charged in a statement that the IRS is attempting to “cover up the fact that it convenient lost key do ents in the investigation.”
    If Lerner is the central figure in the scandal — Oversight Committee chairman Darrell Issa said Monday evening he believes she was the senior-most official involved — Flax may be an important auxiliary figure. E-mails produced in response to a Freedom of Information Act request from the group Judicial Watch show Flax giving the green light to Lerner’s request to meet with Department of Justice officials to explore the possibility of criminally prosecuting nonprofit groups — at the suggestion of Democratic senator Sheldon Whitehouse — for engaging in political activity after declaring on their application for nonprofit status that they had no plans to do so.
    E-mails uncovered by the committee last week showed that, in preparation for her meeting with the Department of Justice, Lerner and one of her advisers transmitted 1.1 million pages of data on nonprofit groups, including confidential taxpayer information, to the Federal Bureau of Investigation, potentially in violation of federal law.

    If I were Lerner, I wouldn't give to the Repug inquisitors, I'd plead the 5th, WHICH is ANYBODY'S CONS UTIONAL RIGHT, and make them deal with that.

    The teabaggers applied for tax exempt status under Section 501(C)(4) of the Internal Revenue Code. This is the section for tax-exempt "social welfare organizations."

    Says the IRS, "To be operated exclusively to promote social welfare, an organization must operate primarily to further the common good and general welfare of the people of the community (such as by bringing about civic betterment and social improvements)."

    In addition to attempting to disrupt and overthrow the 2008 and 2012 presidential elections and working to take over legislative bodies at all levels from school board to the U.S. Congress, this is what the tea party does....






    Someone please tell me how this activity qualifies as "promoting social welfare." Until you can, in a way that makes sense, these guys need to remain under Section 529, which is NOT tax-exempt.....

    Sounds like the loss might be due to antiquated computer procedures and general government incompetence.

    Lots of other info has also gone missing from the IRS. This is not an isolated incident apparently.

    Left and Right both duck that hurdle by claiming "education" is a public good. They can advocate issues all they want, they just can't advocate specific candidates.
