    It is one thing to do a stupid thing like slapping someone for the sake of a goty filming...

    It is another thing - and a really stupid thing - to then turn your back on the offended person and leave yourself unprotected.

    Got what he paid for.

    Dude slapped him across the face and then taunted him. If you're going to assault/batter someone then laugh at them, you really, really shouldn't turn your back.

    Seriously. What kind of moron batters someone, then laughs at them thinking there will be no repercussions?

    Depends if they were all friends and do that to each other all the time. If so punching is a bag move. However, you don't let someone know you're about to hit them. That's called watching too much television.

    Overview of Texas Assault and Battery Laws

    Many states treat assault and battery as two separate crimes, whereas some treat them as the same. In Texas, the elements for a case against a defendant for assault and battery are the same. Prosecutors must prove one of the following:

    • The defendant intentionally, knowingly or recklessly caused bodily injury to the victim;
    • The defendant intentionally or knowingly threatened the victim with imminent bodily injury; or
    • The defendant intentionally or knowingly caused physical contact with the victim when the defendant knew or should have reasonably believed that the victim would regard the contact as offensive or provocative.

    The crime of assault may be elevated to the crime of aggravated assault in certain cir stances. Aggravated assault includes the same elements of the crime of assault, but it involves either the use or exhibition of a deadly weapon during the act of assault, or it can involve causing serious bodily injury to the victim.

    In most states (including my home state of CA) assault and battery are separate. Do we know this incident was in Texas?

    in most states only the second bullet point in your post would be part of an assault claim. Combining assault and battery is pretty stupid, because there could easily be a case of assault where nobody gets hurt or even touched
