    No. Texas law does not provide anywhere for a 50/50 division. Section 7.001 of the Texas Family Code states:

    "In a decree of divorce or annulment, the court shall divide the estate of the parties in a manner that the court deems just and right, having due regard for the rights of each party and any children of the marriage." TX Fam Code Sec. 7.001.


    There are many factors taken into account by a court when it divides a community estate, and there is no presumption in favor of 50/50 or anything else.

    it was finalized back in August, and none of the details were released publicly, regarding custody or assets. all we know is they are divorced and Duncan came in with a prenup

    Another primary lesson from Duncan's divorce is the potential importance of a prenuptial agreement when one party has large assets. Duncan is reportedly attempting to enforce the prenup between him and his wife Amy. Duncan and his wife met while they were both in college at Wake Forest where he played basketball and she was a cheerleader. Duncan went pro after graduating with a Psychology degree in 1997, but did not get married until 2001. Duncan was already well into his multimillion dollar player contract as well as several endorsements. His prenuptial agreement most likely covered the assets he brought into the marriage and his earnings during the marriage, and future earnings and division of assets after the marriage. NBA star Kobe Bryant, who also got married in 2001 did not have a prenup and half of his estimated $150 million net worth was subject to the divorce in 2011.
