Marsha Blackburn is an extremist and a “birther”, who isn’t known for her command of factual information, so putting her in charge of a fact-finding expedition is fraught with peril for the GOP.
The odds of the committee looking foolish are astronomically high with Blackburn at the helm.

Federal court strikes down Wisconsin anti-abortion law similar to Texas statute
A Wisconsin law requiring doctors who perform abortions to have admitting privileges at a nearby hospital is uncons utional, a U.S. appeals court ruled on Monday, addressing a topic the U.S. Supreme Court is considering during its current term.Abortion providers in Wisconsin had challenged the state law, which requires doctors to have privileges at a hospital within 30 miles (50 km). The law’s supporters said the measure ensures continuity of care while opponents say it serves almost no public health value and is intended to shut clinics.
A federal judge in March permanently blocked the Wisconsin law, ruling that the health benefits, if any, were outweighed by the burden on women’s health caused by restricted access to abortion.
The U.S. Supreme Court earlier in November agreed to take up a major abortion case for the first time since 2007. In that case, Texas abortion providers are challenging state requirements that they have admitting privileges and costly hospital-grade surgical facilities.
In the Wisconsin case, the 7th Circuit U.S. Court of Appeals said a statute that curtails the cons utional right to an abortion, such as the Wisconsin and Texas laws, cannot withstand challenge without evidence that it is justified by benefits.
The evidence presented to the Texas legislature and discussed in the 5th Circuit U.S. Court of Appeals was weak and was nonexistent in the Wisconsin case, Judge Richard Posner found in an opinion concurred in by Judge David Hamilton.

Planned Parenthood sues Texas over threat to cut Medicaid funding
Planned Parenthood, other women’s health providers and a group of women in need of reproductive healthcare sued Texas on Monday, seeking to halt its threatened cut in Medicaid funding, a move they said was more about politics than healthcare.
The suit filed in federal court in Austin comes as Texas and several other Republican-controlled states try to cut funding for Planned Parenthood after an anti-abortion group released videos it said showed Planned Parenthood officials negotiating prices for fetal tissues from abortions it performs.
“By cancelling Planned Parenthood’s Medicaid contract, these politicians are telling women where they can and cannot go for reproductive healthcare. And let’s be clear: That is illegal and it’s a violation of federal law,” Cecile Richards, president of Planned Parenthood Federation of America, told a teleconference with reporters.

RHRealitycheck Explains How Center For Medical Progress Is Desperate To Hide The Backers Behind Its Deceptive Planned Parenthood Videos
The anti-choice Center For Medical Progress (CMP) has secretly and possibly illegally recorded footage of abortion providers that was subsequently deceptively-edited to smear Planned Parenthood. The resulting videos have been heavily promoted by Fox news, which even went so far as to suggest CMP should qualify for a Pulitzer Prize.
However, CMP has been embroiled in a lawsuit with the National Abortion Federation based in part on the violation of confidentiality agreements it signed in order to participate in NAF's conferences under false pretenses.
On December 9, RHRealitycheck's Imani Gandy reported on the lengths CMP has gone to hide the funders and supporters of its campaign to smear Planned Parenthood, despite a court's determination that this information is necessary to determine if the anti-choice group was part of an illegal conspiracy.
[A]ny possibility that [Planned Parenthood] will be found to be in violation of policies regarding fetal tissue donation seems to be flickering out.
What remains, then, are questions about whether or not David Daleiden himself and the organizations he created--CMP and BioMax Procurement Services, the fake tissue procurement company--broke federal and state laws in connection with their crusade against Planned Parenthood, and who coordinated with Daleiden to perpetrate this alleged fraud.
These questions have been teed up in federal court in San Francisco, where a discovery battle has been raging between the National Abortion Federation (NAF) and Daleiden for several months.
"Discovery" is the process in litigation whereby parties to a lawsuit have to, essentially, lay their cards on the table and turn over information that the other side might need to support their claims or defense. And in the lawsuit that NAF filed against CMP, discovery is the process that could unravel a conspiracy involving multiple players all acting in concert to take down Planned Parenthood. Such players may include anti-choice extremists connected to groups like Live Action and Operation Rescue, in addition to some of the anti-choice politicians who jumped at the opportunity to hold congressional hearings and form investigative committees about Planned Parenthood's supposed das ly deeds.

Within weeks of the first video release, NAF filed a lawsuit in federal court against CMP, BioMax, David Daleiden, Troy Newman (the founder of radical anti-choice extremist group Operation Rescue), and a number of thus far unidentified alleged other parties. Among other civil and criminal allegations, the lawsuit alleges a conspiracy to defraud NAF, perpetrated for the purpose of intimidating and harassing abortion care providers.
Days after NAF filed its lawsuit, it won a temporary restraining order (TRO) blocking CMP from releasing additional footage or other materials that NAF alleges CMP fraudulently acquired at NAF meetings. The judge who issued the temporary restraining order, William Orrick, also ordered CMP and Daleiden to provide responses to NAF's discovery requests: testimony, do ents, and other evidence that NAF needs in order to prove its case that the temporary restraining order should be converted into a preliminary injunction continuing to block the video release.
The most important information sought by NAF is probably the video recordings themselves, many of which were surrep iously recorded at private NAF events in violation of the explicit nondisclosure agreement that CMP members were required to sign before they could gain entrance into NAF's annual meetings in 2014 and 2015. The confidentiality agreements are one piece of an extensive security protocol that NAF put in place to protect attendees from anti-choice terrorism.
Daleiden and CMP maintain that the TRO and any preliminary injunction that the court might issue cons utes "prior restraint," or pre-publication censorship, in violation of the First Amendment. Daleiden believes that the confidentiality agreement that he signed is invalid because in his mind, NAF is an accomplice in Planned Parenthood's baby parts trafficking scheme.
NAF has countered, and thus far Judge Orrick seems to agree, that First Amendment rights can be waived by contract, which is exactly what Daleiden did.
And considering that no federal or state agency has found Planned Parenthood guilty of anything, Daleiden's continued insistence that he's an investigative journalist on a crusade to expose the illegal sale of aborted fetal tissue has begun to ring rather hollow.

Judge: No evidence of crimes in recordings of abortion group
Recordings secretly made by an anti-abortion group at meetings of abortion providers do not show criminal activity and could put the providers at risk, a federal judge said Friday, citing the recent shooting at a Colorado Planned Parenthood clinic.
U.S. District Judge William Orrick made the comments during a hearing over the National Abortion Federation's request for a preliminary injunction that would continue to block the release of the recordings. Orrick did not immediately issue a ruling.
He previously issued a temporary restraining order blocking the recordings pending the outcome of the preliminary injunction hearing.

Texas Boots Planned Parenthood from HIV Program
Texas just couldn’t end 2015 without one more jab at Planned Parenthood.
According to a press release from Planned Parenthood Gulf Coast (PPGC) in Houston, the Department of State Health Services (DSHS) did not renew the organization’s HIV Prevention Program funding for 2016. The program pays for HIV and STD education, counseling, screenings and other prevention services like condom distribution.
According to DSHS, more than 80,000 Texans are living with HIV, and in 2014, more than 4,000 Texans were newly diagnosed with the virus.
Funding for the HIV Prevention Program comes from the federal Centers for Disease and Prevention (CDC), with Texas’ DSHS as the intermediary that funnels the money to community organizations. Planned Parenthood Gulf Coast received $600,000 to provide HIV screenings in the Houston area, including Harris, Galveston, Brazoria, Fort Bend and Montgomery counties.
According to the DSHS HIV Surveillance Report, 1,289 Harris County residents were diagnosed with HIV in 2014, the highest number of new cases that year across all 254 counties.
PPGC began providing HIV screenings 28 years ago and received a state grant to do so. The grant expires on December 31, 2015. Come January 1, 2016, the organization will no longer provide HIV screenings.
In a statement released today, PPGC CEO and president Melaney Linton called the news “devastating.”
“Our HIV Prevention Program team has tested tens of thousands of people in jails, bars, night clubs, college campuses and many other places across our service area,” she said. “The team helped people overcome their anxieties to get tested and learn their HIV status, and educated them on reducing their risk exposure.”
Requests for comment from DSHS and the CDC were not immediately returned.
Planned Parenthood officials said the organization will still provide STD testings at its health centers.

New poll conducted in wake of deadly attack on Planned Parenthood clinic finds public support for abortion rights at highest point in two years
Public support for legal abortion in the United States is at its highest point in two years, with nearly six out of ten people backing the reproductive right, according to a new poll(pdf) conducted in the wake of last month's mass shooting at a Colorado Planned Parenthood clinic that killed three people.
The Associated Press and GfK, which jointly conducted the survey, found that 58 percent of respondents say abortion should be legal in "most or all" cases. This marks a jump from 51 percent at the beginning of the year. The poll is based on surveys of 1,007 adults conducted in early December, with a margin of error of plus or minus 3.4 percentage points.
Notably, the hike reflects an incremental rise in support among respondents who identify as Republican, with 40 percent backing legal abortion, up from 35 percent in January. Seventy-six percent of Democrats responded in the affirmative, compared to 54 percent of Independents.

The U.S. Supreme Court on Tuesdayturned away a request by anti-choice lawmakers to review an Arkansas law that bans abortion at 12 weeks of pregnancy with narrow exceptions, letting stand an appellate court ruling striking the measure as uncons utional.
Arkansas’ SB 134, known as the “Arkansas Heartbeat Protection Act,” outlaws abortion when a fetal heartbeat has been detected—which can be as early as six weeks’ gestation—and at 12 weeks, with narrow exceptions for the life of the pregnant person, cases of rape or incest, and those that involve a “lethal fetal disorder.”
The law, considered to be among the most radically restrictive in the nation, has been blocked by a federal judge since March 2014. Attorneys for the state urged the Roberts Court to take the case anyway, arguing the time was right for the Court to review the “rigid” viability framework put in place by Roe v. Wade and Planned Parenthood v. Casey that prevents states from banning abortions prior to fetal viability.

Supreme Court Won’t Revive Radical Six-Week Abortion Ban
The U.S. Supreme Court on Monday refused to revive a North Dakota law that would ban abortion as early as six weeks into pregnancy, letting stand a federal appeals court decision striking it as uncons utional.
At issue is HB 1456, signed into law by Republican Gov. Jack Dalrymple in March 2013. The measure bans abortions as soon as a fetal heartbeat can be detected, which can be as early as six weeks post-fertilization.
The law contains a very narrow exception for when the life or health of the patient is in danger, and subjects any provider who violates it to felony criminal charges.

Grand Jury Indicts Abortion Foes Behind Undercover Videos
A Harris County grand jury on Monday indicted the videographers behind undercover recordings of a Planned Parenthood clinic in Houston and cleared the clinic of any wrongdoing.
The indictments — part of the county prosecutor's’ investigation into allegations that Planned Parenthood was illegally selling fetal tissue — include charges against anti-abortion activists David Daleiden and Sandra Merritt for tampering with a governmental record. The grand jury handed down a second charge for Daleiden for “Prohibition of the Purchase and Sale of Human Organs.”
The grand jury cleared Planned Parenthood Gulf Coast in Houston of any wrongdoing.
State Republican leaders last year pushed for investigations into Planned Parenthood after videos were released depicting Planned Parenthood officials across the nation discussing how their providers obtain fetal tissue for medical research.
Among the undercover videos were recordings of staff at Houston-based Planned Parenthood Gulf Coast, where two abortion foes in April misrepresented themselves as research executives and provided fake California drivers’ licenses.

Planned Parenthood Sues CMP Over Undercover Videos
Planned Parenthood filed a federal lawsuit against the Center for Medical Progress Thursday over its release of undercover videos that exposed the non-profit’s dealings in fetal tissue parts.
The series of videos “did their intended damage,” reads the formal complaint, which alleges CMP and it’s project lead David Daleiden violated federal law and laws in three states, including secret taping and trespassing in the course of its years-long investigation.
“Millions of people who viewed the manipulated videos and inflammatory accusations were made to believe that Planned Parenthood had violated the law and acted improperly,” adds the complaint.
CMP obtained the footage of Planned Parenthood executives and top doctors during a 3-year-investigation, and alleges Planned Parenthood is illegally profiting from the sale of harvested fetuses. Planned Parenthood denies the allegations and quickly accused CMP of doctoring the videos.
