I was thinking the same thing. I'm leery of the prosecution doing something stupid like over-charging him with first degree murder. Don't they have to prove premeditation was involved for that charge to stick? Why not charge him on something easier to convict like second degree murder or man slaughter and then seek the max penalty? This reminds me of Florida stupidly (and probably purposely) over-charging George Zimmerman on second degree murder when starting out with manslaughter would have been the easier charge to convict.

cover up, it appears. it differs from the police report (similar to the Walter Scott killing in S. Carolina. its telling that the police contested the release of the video. When they lost, they dumped the video two days before Thanksgiving and charge the cop with murder. Cop shot a man, walking away from him. he then shot him 14 times as he bleed out on the ground. it doesn't take 400 days to tell if that was murder.
