Donald Trump’s practice of using money from his charitable foundation for his personal benefit are obvious violations of the law and even have the potential of getting the Trump Foundation shut down, charity law experts told TPM.
One non-profit attorney said that Trump was “flirting” with violating an IRS regulation that would, in effect, terminate the foundation.
Another lawyer – a former chief of the Charities Bureau in the New York State Attorney General's office – said it was “conceivable” that an attorney general could seek to dissolve a foundation for self-dealing, if they can prove “it’s not really acting like a charitable foundation.”
A Washington Post report this week described a series of instances in which Donald J. Trump Foundation funds were used improperly -- and perhaps, illegally -- by Trump in transactions that suggest he was “self-dealing,” a well-known and long-held no-no for private foundations.
Legal experts who work in the non-profit world told TPM that the cases described by the Post report are well outside the norm.
“In this day and age -- the law has been around since 1969 -- it’s pretty clear,” said Marcus Owens, an attorney at Loeb and Loeb in Washington who represents nonprofit organizations.
“It’s rare to see acts of self-dealing. It’s extremely rare to see a pattern of self-dealing.”

Law Prof Says There is Aready Enough Evidence To Impeach Donald Trump If He Beats Hillary
University of Utah Law Professor Christopher Lewis Peterson penned a 23-page article analyzing why it would be proper for Congress to impeach Trump if he’s elected.
He believes that Trump has engaged in fraud and racketeering which meets the standards under Article II of the United States Cons ution which reserves impeachment for “high crimes and misdemeanors.”
“Unlike his promised crimes yet to come, the illegal acts in Trump’s high pressure wealth seminars have already occurred.
Indeed, a federal judge appointed under Article III of the U.S. Cons ution has already determined that Trump’s alleged actions, if true, cons ute fraud and racketeering,”
Peterson wrote. While Peterson acknowledges there would be some legal hurdles, he contends that the
Cons ution does not prohibit Congress from impeaching a President for alleged acts that happened prior to taking office.
“Congress would be well within its legal rights under the Cons ution to insist upon a President who is not a fraudster or a racketeer as defined in its own law,”
Peterson wrote. Another issue that Peterson acknowledges is that if Trump wins, this would be seen as referendum against any kind of impeachment. After all, the people voted him in knowing he was facing lawsuits as it relates to Trump University. Peterson has an answer for that too.
“Trump appears to have lied about his role in Trump University to students, he has throughout the election continued to misrepresent the cases that focus on his misrepresentations,”
Lewis wrote. Therefore, Peterson contends that the American public might not have been aware of the full extent of his transgressions.
Right now, Donald Trump is facing three different lawsuit surrounding his role at Trump University. New York Attorney General Eric Schneiderman filed a $40 million civil suit against the University for alleged illegal business practices and fraud. None of the cases have been resolved, and all are ongoing. Trump has repeatedly denied his school ripped off students.
