    Why Trump Has Declared War on the Judiciary

    He’s making things awkward for his SCOTUS nominee and hurting his chances in court. What’s his endgame?

    There is no longer any doubt that President Trump is at war with the federal judiciary. The more the courts align against him, crossing virtually all ideological and political divisions to do so, the more he insists they are partisan and “political” and willfully endangering the country. The only questions remaining are how this will affect the Neil Gorsuch nomination and why Trump is waging this particular war

    The outcry against Trump’s not-so-veiled threats was swift and bipartisan. But the president didn’t stop. On Wednesday, the day after the 9th U.S. Circuit Court of Appeals heard oral arguments over the travel ban, Trump accused the judges—who at that point were still considering the case—of playing politics.

    He also took to Twitter to suggest, again, that a future terror attack would be the responsibility of the judges hearing the appeal:

    To be clear, what the president is doing is blaming the court for politicizing the court. By acting like a court.

    Nobody should be surprised that there are now reports of threats against the federal judges who heard the appeal at the 9th circuit. ( Bannon's white nationalists/militia less goons acting like Mafia killing judges in Italy )Those threats have prompted federal and local law enforcement to increase security protection for those judges.

    “President Trump is not threatening a judge, and he’s not encouraging any form of lawlessness,” Leo said.

    No matter how often or how loudly you say that attacks on individual jurists don’t threaten the judiciary or judicial independence, anybody with eyes can see that is what’s happening.

    Although Gorsuch’s own spokesman confirmed his remarks, Trump responded by insisting that Blumenthal was lying and by noting that Blumenthal didn’t serve in Vietnam. And look at that squirrel over there!

    Trump has now tied his nominee to a larger debate about the rule of law and the role of the judiciary.

    That’s a debate the Senate will now take up in Gorsuch’s confirmation hearing, and one that the nominee will not be able to sidestep with claims that the issue may come before him at the Supreme Court.

    For another, I suspect that Gorsuch will be alarmed enough by the fact that his colleagues on the federal bench are receiving death threats and extra security details that he will find it very hard to do anything but continue to condemn the president

    What is Trump’s grand plan here? Mostly, I continue to believe that

    his attacks on the judicial branch are deliberately destabilizing for their own sake

    and that they are
    deliberately politicizing a branch of government about which Gorsuch cares a good deal.

    Trump wants to lose in court or because Trump and Steve Bannon want to delegitimize the court system more generally feels immaterial. No judge will stand for it. They are well aware of the stakes here.

    it becomes ever harder for Neil Gorsuch to avoid wading in to this fight. At this point, staying on the sidelines during Trump’s war against the judiciary feels like an abdication of fundamental responsibilities.

    In Meeting With Senators, Trump Referred to Elizabeth Warren as ‘Pocahontas’ Several Times

    In a meeting with Democratic and Republican members of the Senate, President Donald Trump brought up a couple of blasts from the past.

    According to Politico, Trump told the ten senators sitting in the room that he would have won New Hampshire in the election if there wouldn’t have been thousands of people bused in from Massachusetts to illegally vote.

    This was, of course, doubling down on his previous, unsubstantiated claims of massive voter fraud.


    According to participants in Thursday’s meeting, Trump referred to Warren several times as “Pocahontas,” the moniker he gave her during his campaign, and told the Democrats he was glad Warren is becoming the face of “your party.”

    Wow. It's already a bargain at 21 billion. The Feds make 61 billion a year off of student loan interest. Obama dropped 980 billion on stimulus in his third month. Plus we get leverage in our next trade deal with Mexico.

    Sen. Al Franken (D-Minn.) said Friday night that his Republican Senate colleagues privately express “great concern” about President Trump's temperament, and he joked about the GOP eventually impeaching Trump.

    Franken joked: “Well, there's a range in what they'll say, and some will say that he's not right mentally. And some are harsher.”


    “No, no. That's not fair. That was cheap,” he continued. “There are some who I guess don't talk to me.”


    Franken then got a bit more serious.

    The intrigue, fighting and back-stabbing within the Trump administration just three weeks in is enough to compete with the War of the Roses.

    New Jersey congressman invokes 1924 tax law giving Congress power to examine Trump's tax returns

    Rep. Bill Pascrell (NJ-09) serves on the House Ways and Means Committee and he wants to use a 1924 tax law that allows Congress to examine tax returns for the purpose of determining whether conflicts of interest exist, even if those tax returns belong to the president. From NorthJersey.com:

    After privately examining returns -- Pascrell is seeking 10 years' worth -- the committee could decide to share them with the full House, which would in effect make them public.

    The 1924 law gives congressional committees that set tax policy the power to examine tax returns.

    It was used in 1974 when Congress looked at President Richard Nixon's returns, and

    in 2014 when the Ways and Means Committee released confidential tax information as part of its investigation into the Internal Revenue Service's handling of applications for nonprofit status

    If Sen. Mitch McConnell can invoke the rarely used “Rule 19”, Rep. Pascrell and Congress are well within their rights to evoke this 1924 tax code and do what the law requires to ensure there are no conflicts of interest. Pascrell said he’s not going to take “no” for answer:

    Pascrell said foreign governments are paying rents, licensing fees, and issuing permits for Trump Organization projects, all of which could be used to influence the president.The letter asked Brady to reply by Wednesday.


    “If I get a ‘no’ answer on this, I’ll be very honest with you:

    If these guys think I’m walking away from this, they’re absolutely nuts," Pascrell said.

    "The calls we’re getting, the calls other congressmen are getting, it’s unbelievable, we never expected this.”

    Sebastian Gorka's rise from the anti-Muslim fringe to White House aide

    Gorka did go the extra step of writing an NYT bestseller, Defeating Jihad: The Winnable War, but his work still isn’t taken seriously by experts in national security. Allegra Kirkland writes:

    Some foreign policy and counterterrorism experts declined to speak to TPM on the record because of Gorka’s position in the new administration. But others characterized him as a peripheral figure whose hardline ideas about Islam and the threat posed by the Islamic State terror group place him firmly outside the mainstream.


    “I’d heard the name once or twice but he’s not a major figure in the field. He’s not someone whose work one needs to know to be conversant in these issues,” Stephen Biddle, an adjunct senior fellow for defense policy at the Council on Foreign Relations and professor of political science at George Washington University, told TPM.


    Biddle added that Gorka is not “in the reasonable mainstream.” Omid Safi, director of Islamic Studies at Duke University, was much more biting in his assessment, labeling Gorka’s book “propaganda.”


    “He opines on everything from the Koran to Mohamad to jihad to Islamic history to contemporary politics but does so in a way that is inaccurate, sloppy, superficial, bigoted and ideological,” Safi said.

    Gorka used to appear regularly on the radio show of
    noted anti-Muslim conspiracy theorist Frank Gaffney.

    Gaffney has heavily promoted the conspiracy theory that members of the Muslim Brotherhood have infiltrated the U.S. government and argued that the Council on American Islamic Relations, a civil rights group, is affiliated with terrorists.

    Gorka has made the same arguments himself. He has also said that

    accepting Muslim refugees would be “national suicideand that religious profiling of Muslims is a “synonym for common sense.”

    A hastily called news conference caps a surreal day for Trump in South Florida

    A couple of hours later, the news media were led through the gates of Trump’s estate and allowed to witness the two couples standing at the main entrance of the property for what was billed as a photo spray. Reporters, who were asked not to shout questions, did so anyway.

    Trump answered some of them, allowing that he and Abe were having a “very, very good” visit and that during the golf outing, “we got to know each other very, very well.”

    But the president ignored several other questions, including whether he planned to watch “Saturday Night Live” and whether he had anything to say about reports of a ballistic missile launched by North Korea — the first such provocation during Trump’s presidency.


    At that point, the press corps traveling with Trump was whisked back to the Marriott hotel that has served as its home base for the weekend. Trump aides called a “lid,” meaning there were no more planned Trump appearance or travels for the night.


    About an hour later, after many of members of the media had decamped to the hotel bar or ventured out for their first real meal of the day,

    a Trump aide sent an “URGENT” message saying the press pool needed to reassemble immediately for unstated reasons. It turned out Trump did have something to say about North Korea.

    Reporters were then taken back to a heavily secured yet bustling Mar-a-Lago. Despite its designation by Trump as his “winter White House,” other events continue to be held on the property.


    Trump then took his turn at the lectern, offering this brief statement:

    “I just want everybody to understand and fully know that the United States of America stands behind Japan, its great ally, 100 percent.”


    Trump made no mention of South Korea, another U.S. ally in the region,

    nor did he explicitly condemn North Korea's action.

    The two men exited the room without taking questions.


    As reporters were ushered out, another “lid” was called, ending a long day of Trump movements.

    All that was left was the latest episode of “Saturday Night Live,” in which actor Alec Baldwin continued to lampoon the new president.
