The court makes assumptions like that based on the state of the case, not as a factual finding. For instance, if a party files a motion todismiss , the court will look at the evidence most favorably to the non-moving party.
The court held that assumption because the question was whether the lawyers has proper standing. In making thedecision , the court doesn't concern the factual merits of the case and assumes them to be true so as to not confuse the true issue (merits of the case vs proper standing)
