I will, as an auditor, ask for things that I already have, mostly as a test to see if the company I am auditing can produce the do ents in a timely fashion. A company dragging their feet, or unable to produce things is a red flag.
Not sure how it works with prosecutors.

Historically, yes. Pretty easy stuff to figure out. The most recent example I can think of is Patrick Fitzgerald and the Plame affair. The scope of that investigation was comparatively narrow and it was two years before any indictments came out.
