you should probably read his plea deal again if you think he's getting any jail time for a process crime
Flynn has to check in once a week as the Judge states until his hearing February 1st. So technically, no he is not a free man.
There may be superceding charges to avoid that. Mueller indicts on a lesser charge. Then if pardoned, plenty of other charges to bring.
