Judge Gregory Keosian stated that being misidentified as transgender does not inherently expose someone to "hatred, contempt, ridicule or obloquy," and therefore does not rise to the level of defamation.
"While, as a practical matter, the characteristic may be held in contempt by a portion of the population, the court will not validate those prejudices by legally recognizing them," Keosian ruled.
The case arose from Simmons suing after the National Enquirer and some other rag falsely labeled him as tranny. flames, no doubt, but they went wayy overboard and plastered their false all over supermarkets across the U.S.
Not only did this judge rule no damage was done, he ordered to pay the National Enquirer $130,000.

I can see the OP's point and the slippery slope issue.
Suppose a non-transgender applied for a job that specifically required a non-transgender employee. But the boss believed a rumor that said applicant was transgender and did not give the
person the job. But instead gave it to a less qualified non-transgender.

Another likely scenario...
Suppose there is a non-transgender marathon and then that non-transgender guy ends up winning it.
But then at the end of the race, just before he gets the $1,000,000 prize and trophy, the judge hears the rumor about him being transgender.
Then they give the money and trophy to some dude in a wheelchair.
And when the original non-transgender tries to speak up, a German Shepard that's been trained to kill transgenders, mauls him to death.
