What you might have missed in the Cohen plea

President Trump’s former personal attorney Michael Cohen has accused Trump of directing him to commit crimes with the intention of improperly influencing the 2016 election. That is stunning and will have ramifications

If the accusations are true, Trump will have committed a crime, should be impeached and, after leaving office, prosecuted.

Did you notice all the other people implicated in Cohen’s plea?

There is “Corporation-1,” presumably American Media Inc. (AMI), which owns the National Enquirer (“Magazine-1”).

Members of Corporation-1 (including editor in chief, or “Editor-1”) would presumably have information and be able to corroborate Cohen’s account regarding the Karen McDougal payoff.

The information do ent filed against Cohen also notes the existence of a text between Editor-1 and Cohen, corroboration of the arrangement to pay off a second woman, presumably Stormy Daniels.

    let’s not forget the “executives of the Company” [Trump’s] who “grossed up” the reimbursement to Cohen;

that’s two or more additional witnesses.

We learn that “Executive-1” received the request or reimbursement and shared it with more executives. More witnesses.

In Count 7, Cohen is accused of enabling Corporation-1 to make an illegal corporate campaign donation.

That means the company and/or its executives might have liability as well.

Count 8 mentions campaign executives (who might they be? how many?) who worked with Cohen to effectuate the scheme.

it’s not Cohen’s word against Trump’s, but rather

a raft of witnesses whom prosecutors have or will be able to talk to (some to avoid liability of their own) and do ents as well.

There is, in short, a ton of evidence out there concerning the campaign finance scheme to make sure two women didn’t mess up Trump’s chances of getting elected.

While the legal implications of Cohen’s plea are stunning,

let’s not forget the immediate political ramifications when a president is accused of breaking the law to get elected.

a scheme was cooked up to prevent them from finding out. It stands to reason that

    Trump gained the presidency illegitimately.

it is very possible that Trump was rightthe revelations about Daniels and McDougal, in addition to the “Access Hollywood” tape, could have sunk him.

He thought that was the case, so why shouldn’t he pay them off?

Cohen will still need the prosecutors’ help if he wants a reduced sentence and to avoid other charges from being leveled.

It’s inconceivable that Cohen, to obtain the benefit of the plea deal, wouldn’t be required to testify and provide other assistance (e.g. letting prosecutors into his phone).

Cohen has the means and the motivation to expose Trump, at the very least with respect to the payoffs that helped get Trump elected.

Cohen therefore not only poses a legal threat to Trump but also

has the ability to delegitimize Trump’s presidency.

This is big — really big.

Looks like the Enquirer is going to go down the ter. Good riddance.

“Later on I knew. Later on. But you have to understand, what he did -- and they weren’t taken out of campaign finance, that’s the big thing. That’s a much bigger thing. Did they come out of the campaign? They didn’t come out of the campaign, they came from me. And I tweeted about it. You know, I put -- I don’t know if you know but I tweeted about the payments. But they didn’t come out of campaign. In fact, my first question when I heard about it was did they come out of the campaign because that could be a little dicey. And they didn’t come out of the campaign and that’s big."

April 5, 2018 — In his first public comments about Daniels, Trump tells reporters aboard Air Force One that he didn’t know about Cohen’s payment.

Asked whether he knew about the payment, Trump says flatly: “No.” Asked why Cohen made the payment, he says, “You’ll have to ask Michael Cohen.”

When asked where Cohen got the money, Trump says, “I don’t know.”

    "They came from me."

cohen's indictment says he got the $400K+ from the Trash Org, not Trash personally.

but it's never clear WTF Trash is talking about.

Sometimes it's difficult to remember where the payment comes from. I have a hard time keeping track remembering if I paid out of a personal account, investment account, business account. Did my lawyer pay this? Or my financial advisor? Or my book keeper?

Chris is right though. There was no crime concerning campaign finance violations therefore no crime linked to Trump. Had Cohen faught that count in court he’d have won. He plead guilty to it to get leniency for the actual crimes he committed. Slimy move by the prosecutors to try and link a “crime” to Trump.

If Cohen would have won instead of taking a plea deal then Trump is right, he really isn't a good attorney.

    False confidence.

Was part of the deal also for his lawyer to continue to verbally implicate Donald Trump in these charges he would have beaten?

That would be somewhat unprecedented in the history of plea deals. Usually a side benefit of a deal like this is you don't have to talk about the crime you were accused of anymore.
