Boy sues school for gender discrimination over expulsion after admitting to sexual harassment
a high school student and his father in Virginia are trying to sue for gender discrimination after the school expelled the boy for sexually assaulting and harassing female students.
The school did an investigation and found him responsible for committing those acts, and
he was forced to transfer to an alternative school.
He even confessed to exposing his genitals
and making sexually explicit remarks, but said they were just “jokes.”
In true Betsy Devos-esque behavior,
the student punished for assault is framing himself as the true victim here.

It’s possible the complaints will never be investigated if the lower-court judges determine they have no jurisdiction over a Supreme Court justice under the judiciary’s ethics rules.
The judges may be forced to conclude “that intervening events have rendered the allegations moot or make remedial action impossible,” said Arthur man, an ethics professor at the University of Pittsburgh.
Another ethicist, Stephen Gillers of New York University, disagreed that the complaints are moot.
Kavanaugh remains a federal judge and the complaints “allege misconduct that occurred while Kavanaugh was on the D.C. Circuit and subject to the Code of Conduct for U.S. Judges.
Any violation of the Code does not disappear because he is now on another federal court,” Gillers said in an email.
But Gillers said the complaints “may be found not to be meritorious in the end.”

Complaints against Brett Kavanaugh in the D.C. Circuit, the federal appeals court that hears appeals from D.C., have just been passed along a second time.
challenging as unethical Kavanaugh’s statements during his first Senate confirmation hearing and his response to allegations of sexual assault.
Here’s the money passage from the first complaint, filed by the Democratic Coalition:
Kavanaugh violated Canons 1 and 2 of Code of Judicial Conduct by committing crimes of dishonesty while he was a federal judge,
by obtaining confirmation of his appointment as a federal judge by false and perjurious testimony,
by concealing and covering up his criminal actions and by obstructing justice.
He is unfit to serve as a judge by reason of his corrupt, unscrupulous, dishonest and criminal conduct.
The complaint points to Kavanaugh’s claim that he didn’t use materials stolen from Democratic offices by a Republican operative, Manuel Miranda, and had no knowledge of the offense.
Enter the second complaint filed, also from the coalition;
it takes aim at Kavanaugh’s “public and partisan campaign of lies to cover-up [sic] and conceal sexual misconduct and crimes he committed in the past.”
The complaint cites his appearance on Fox News and perjury before the Senate Judiciary Committee.

The complaints do not pertain to any conduct in which Judge Kavanaugh engaged as a judge.
The complaints seek investigations only of the public statements he has made as a nominee to the Supreme Court of the United States.

When I clerked on a federal appellate court, even our gym gear and bumper stickers were policed.
Problem is, Supreme Court justices aren’t subject to the canon of ethics. Still, there’s hope. The D.C. Circuit limited its consideration of complaints against Kavanaugh to those relating to his behavior while serving as a federal appellate judge.
