Acting Attorney General Once Declared Courts ‘Inferior’ and Criticized Supreme Court’s Power
The acting attorney general, Matthew G. Whitaker, once espoused the view that the courts “are supposed to be the inferior branch” and
criticized the Supreme Court’s power to review legislative and executive acts and declare them uncons utional,
the lifeblood of its existence as a coequal branch of government.
Mr. Whitaker indicated that he shared the view among some conservatives that the federal judiciary has too much power over public policy issues. He criticized many of the Supreme Court’s rulings, starting with a foundational one: Marbury v. Madison, which established its power of judicial review in 1803.
Simultaneously criticizing the Supreme Court’s power of judicial review while criticizing cases where it declined to strike down laws regulating economic and health insurance matters, was a sign of an “internally contradictory” and “ignorant” philosophy, Mr. Tribe said.
Mr. Whitaker’s views likely would have faced sharp scrutiny even from Republicans in a confirmation hearing.
“He seems to think much of the fabric of federal law that is part of our ordinary lives violates the Cons ution of the United States to which he is evidently going to take an oath,”
“We need to do everything we can to repeal it, defund it, delay it — we need to do whatever it takes,” Mr. Whitaker said of the Affordable Care Act.
he thinks “life begins at conception,” and to same-sex marriage rights, saying that “it’s traditionally been up to the churches and to God to define that.”
Mr. Whitaker said he believed the federal government should play no role in public education.
Mr. Whitaker said he was “not a climate denier,” but also said that while the globe may be warming and human activities may contribute, “the evidence is inconclusive”

Mueller working on final report, Trump hasn't turned in his homework
After months of declaring he was “eager” to talk to Special Counsel Robert Mueller, and
notably doing everything but talking to Special Counsel Robert Mueller,
Donald Trump agreed in September to answer questions from Mueller’s team in writing.
Though even that took a lot of negotiation, and
Trump made it clear he wouldn’t talk about obstruction, not in any format.
But even though Trump has had more than two months,
he hasn’t turned in the answers to his questions.
Which makes CNN’s report that Mueller has begun drafting the final version of his report somewhat problematic.

There’s been no indictment of anyone connected to Cambridge Analytica, despite a plethora of evidence that they were using both stolen social media information and working directly to support Russian efforts.

I'd be confident that any court would side with a forced resignation.
The entire planet knew Trump wanted him gone.
The entire planet knew Sessions loved the out of that job where he could freely practice his white supremacist policies without worry of a boss who would be offended.
Trump ordered Sessions to turn in his resignation. Yes - sessions could have refused but that really won't matter - he was under duress and any reasonable person on any jury would rule that any reasonable person given an order from the (alleged) President to turn in his resignation was ed either way.
A court will look at a firing/forced resignation with a few rules but one of the big ones is if there was really a choice there. In this case Sessions choice wasn't really a choice - boiled down it will come to that.

No, I don't know any case law but have read of many cases where people have been fired, forced to resign, let go (laid off) under false pretenses, etc...
and in the end received large settlements or judgements in their favor.
Many of those cases - the employer claimed that the plaintiff quit on their own but the court ruled against the company after finding out the exact details. Details such as harassment of the employee to the point where the employee quit because of the harassment - and then was paid a settlement because the company - in essence - forced the employee to resign due to harassment.
Cases where employers use excuses when they want to get rid of someone are pretty common.
This is why attorneys are well paid - they recover money for unlawful termination cases all the time. In most of those cases - the employer goes in with "black & white" written reasons why this is a "textbook" case of a lawful termination only to be found guilty and liable for damages.
But - this is all irrelevant because I don't see Sessions filing a wrongful termination case. This would only be relevant when Trump is being examined for obstruction of justice and there are many other extenuating cir stances that will make the case that trump is guilty. Firing Sessions and replacing him with a guy to thwart the Russia thing is trumps main priority here - and it is unlawful.

Acting Attorney General Matthew Whitaker Scrutinized Over Scam Company and Dark Money Groups
Miami New Times’ Brittany Shammas reported yesterday that Whitaker was “involved in a Miami-based invention-marketing company the Federal Trade Commission shut down last year after calling it a scam.”
“Whitaker not only sat on the board of World Patent Marketing but also once sent a threatening email to a former customer who had complained after he spent thousands of dollars and did not receive the promised services,” Shammas reported.
The Wall Street Journal has added detail to the story, reporting that “Whitaker was paid $9,375 in advisory fees between 2014 and early 2016,” according to do ents filed in the FTC lawsuit.
Before becoming Sessions’ chief of staff in September 2017,
Whitaker also ran a group called The Foundation for Accountability and Civic Trust (FACT) which specialized in accusing Democrats,
including Hillary Clinton, of ethical and legal violations.
In 2016, Whitaker earned more than $400,000 as FACT’s director and president.
The Center for Responsive Politics’ Open Secrets project reported in 2016 that all the group’s
funding in 2014—the year it was organized—came from DonorsTrust, a creation designed to allow right-wing donors to stay hidden as the source of donations:
In other words, an organization “dedicated to promoting accountability, ethics, and transparency”
gets 100 percent of its funds from a group that exists mainly as a vehicle for donors to elude transparency.
DeSmog, a blog that challenges disinformation on climate change, noted this week that in addition to the
$600,000 FACT received from DonorsTrust in 2014,
it also received $500,000 from DonorsTrust in 2015 and $800,000 in 2016.
DeSmog noted that Whitaker labeled an investigation of ExxonMobil by a group of state attorneys general “both uncons utional and unethical.” That investigation led to charges filed last month against the oil giant for hiding what it knew about the dangers of climate change.
Open Secrets also noted a web of connections between FACT and the Judicial Crisis Network
—a group that lobbies for right-wing judicial nominees—including the fact that Neil Corkery served as treasurer of both groups.
A 2016 Right Wing Watch In Focus report on “The Obstruction Lobby” reported on the involvement of Corkery and his wife Ann in launching and funding JCN, which was initially called the Judicial Confirmation Network.

Some midair thoughts (yes, I'm on airplane wifi, so this is all going v-e-r-y s-l-o-w-l-y) on Trump/Sessions/Mueller. My first reaction on the replacement of Sessions with a complete hack was despair; but maybe needs to be rethought 1/

Surely the plan was always to kill the Mueller investigation after the midterm.
But this was probably envisioned as something to go along with a GOP House that would block all other inquiry.
