Multiple Legal Scholars Just Escalated the Challenge of Matthew Whitaker’s Appointment

Several legal scholars have submitted an amicus brief

Trump violated the Appointments Clause of the Cons ution

by appointing Whitaker to his post without the advice and consent of the U.S. Senate (i.e., that Whitaker was not confirmed by Congress).

the order of succession to act as Attorney General in the event of a vacancy has been specifically provided by statute;

and the statute directs the Deputy Attorney General—

who has been confirmed by the Senate in part as a cons utional understudy—to fill the office.”

when any president has appointed an acting Attorney General to lead the Department of Justice

from a role that did not require Senate confirmation,”

Not long after this brief was filed, 15 state attorneys general have also filed an amicus brief in Maryland.

Paul Manafort may not be cooperating over ‘fears of retaliation’ by the Russians

Former Donald Trump campaign chairman Paul Manafort may have intentionally violated his plea agreement —

effectively giving himself a life sentence behind bars —

in order to avoid retaliation from Russian Federation President Vladimir Putin,

Here’s why ‘Whitaker won’t be able to suppress’ Robert Mueller’s report after Manafort proceedings

Mueller made the revelation only after President Donald Trump had turned in his written answers on collusion to the special prosecutor.

“Just about the only explanation for Manafort’s actions are that — as I suggested — Trump was happy to have Manafort serve as a mole in Mueller’s investigation,” Wheeler argued.

“But Mueller’s team appears to have no doubt that Manafort was lying to them.

That means they didn’t really need his testimony, at all.”

“It also means they had no need to keep secrets —

they could keep giving Manafort the impression that he was pulling a fast one over the prosecutors,

all while reporting misleading information to Trump that he could use to fill out his open book test,” she continued.

Wheeler noted a specific line from the status report that Mueller’s team filed on Monday.

“The government will file a detailed sentencing submission to the Probation Department and the Court in advance of sentencing

that sets forth the nature of the defendant’s crimes and lies,

including those after signing the plea agreement herein,” the special counsel’s office promised.

“There’s your Mueller report, which will be provided in a form that Matt Whitaker won’t be able to suppress,”
