According to this atty and long time diver, this arrangement was very dangerous and not the norm:

Attorney Gordon Carey, who practices maritime law, said the captain and crew should have done what they could to put out the fire, but not to the point of losing their own lives.
"They may have an obligation to put themselves at risk, but they don't have an obligation to commit suicide and certain death to save the passengers," he said. "The captain's duty is very, very high. I don't think he has an obligation to kill himself, but he certainly has an obligation to do everything possible ... to get that fire out and to get those people out."
Carey, who is not a criminal lawyer, said it's possible the owner of the boat or captain could face charges if found criminally negligent for behavior or a design so reckless they should know peoples' lives would be at risk in the event of a fire.
Carey has been scuba diving for 50 years and has been on many long-distance voyages to exotic dive spots around the world. He said he's never been on a boat where the passengers slept below deck and he questioned why so many were crammed in a space toward the bow with only one staircase and one emergency hatch.
He said an owner or captain has to anticipate the normal range of risks — from collision to a breach of the hull to high seas to fire.
"If you have either designed or put into place an operation that, knowing the risks that are there, and fire is certainly one of them, that put people in a serious risk of dying, I guess that sort of rises to the level of what I would consider involuntary manslaughter," Carey said. "It's behaving recklessly in the face of known danger."

Well maybe he's never been on an overnighter. Most dive boats are just flat platforms. Damn near all birthing is below deck on any boat. I mean unless you think they went out on a cruise liner.

My first thought on the matter would not be murder. There's easier ways to do it without starting a fire and there's no guarantee starting a fire will kill everyone.

I would not rule out Foul Play of some sort meaning someone doing something in the galley they were not supposed to be doing like freebasing or some stupid . How it could have even been someone put something in the microwave that had metal on it and walked away from it.
