My understanding (based on relating what I heard an expert say)
In new york it is in bent on the defendant simply checking a box in a form. That box was not checked by his lawyer when she submitted it.

Have also read that due to this nature of this damages trial (recall, Trump’s already been found liable as both parties motioned for summary judgement - this is just to establish damages) that it is not really in the defendants best interest to have a jury and that often times requests for juries are denied anyway as a jury is not best equipped to evaluate and decide upon disgorgement.
Opting for a bench trial may not be the error it’s initially made out to be? Do your own research.

I saw the do ent, it's a basic intake form basically with a check box for Jury Trial or Bench Trial, and they checked Bench Trial. But it may have been for good reason beyond just being stupid or angling for appeal.

Disclaimer, I'm fully playing Devil's advocate here and am doubtful that Trump himself is capable of this degree of thought process, but I believe the complaint would not be with the particulars of this case but rather the system that results in the majority of jury trial requests in disgorgement cases to be rejected. The argument would be that they didn't request a jury because they knew a jury demand would be rejected - and ALL defendants in these cases get railroaded.
I don't actually believe that is what they were thinking, but I could see a more reasonable defendant (who cares about the justice system and not just himself) making.

Jury trial is guaranteed by the 7th amendment. He had to have waived it.
I’m not sure about New York State court but this isn’t true for federal court. In federal court you have to timely file a jury demand for civil lawsuits if you want a jury. You don’t automatically get one the way you would in a criminal trial.
