No . That's not a loophole, idiot, that's a restriction on private sellers. If I sell my gun, I am not allowed to gain any background information on you. Were I allowed to do so, I wouldn't have a problem running a a background check on anyone buying a gun. It's just not within my rights, because I am not an FFL SOT dealer. Do you want everyone to be able to check anyone else out through the FBI database? Or do you want private owners to not be able to sell without going through a dealer? That would require registering existing firearms, a daunting task and a tipping of the eventual ban hat to the NRA folks. There is no record of who owns what firearm in most cases. There's no way to force registration. There's no way to police sales. Gun show sales are no different than putting an ad in the paper or selling to your hunting buddy. They are all not tracked. The fact a convicted felon can acquire a gun should be enough to illustrate to you that gun laws do nothing to prevent criminals from getting guns.
How do you police that on unregistered firearms? Don't just give me a problem, suggest a working solution, one that makes sense.The gun seller regulations must require that a seller be fully vetted, qualified, and licensed, insured, and re-registered/licensed annually.
