I believe that you have to purchase the mineral rights in addition to just the property were you to wish to drill on your own land.
I`ve been told that in Texas a person has property rights over the oil under the surface of his land.
I would like to know if that is true and what do you think about that. I am from an oil producing city where the oil is property of the State and i would like to know how this different legislation works for you.

You've already tapped the extent of what I think I know in this area...there's nothing of value underground at my house...so I've never researched it.

If you own mineral rights to a property, you can demand access to those rights. But the person owning the land must be compensated. And if the owner of the surface property doesn't want someone drilling it is difficult to gain access unless someone goes to court to force access. But many wont go that route because it leaves a bad taste in everyone's mouth and really muddies the process. In short it can take a long time and years of negotiating and most don't want to go through all the crap.

I`m actually more interested in what is the opinion of some texans in this matter.
If they think that is better for them, or they think it will be better to have the government owning the oil, or if they just think that no matter if it`s good or bad is just the right thing to do not to mess with someone private property.
Uh, it's better for the property owner to have these rights. Period. Nationalized oil is not a good thing. One step closer to communism.
You put the rights in the property owner's hands and let him/her decide what they want to do with it.

It's very easy to gain access in the courts if you have a problem surface owner. No one likes to really go there because surface owners can be a pain in the ass... but if a surface owner tries to deny a mineral owner access, the court can rule that the surface owner gets NO damages and has a restraining order put on him... and that is VERY easy to do.
