I'd say indictments are much better aimed at Donald Fehr and, even more appropriately, Gene Orza.
Selig isn't an innocent here, but at least he and the owners profess to having tried to get testing. The Union, headed by Fehr and Orza, has done whatever it could to prevent that and has, at times, fostered a culture that approves of the use of PED's -- they've argued vociferously against testing (even when the player reps were demanding it) and, apparently, have gone so far as to tip off players that tests were coming.
I'm no Selig fan, but Fehr and Orza -- to me, at least -- are the enablers.
