(11-05) 20:28 PST -- Giants pitcher Tim Lince was cited for possession of marijuana one week ago in the state of Washington.
Though he faces misdemeanor charges in the state, it is unlikely he will receive any punishment from Major League Baseball.
The 2008 Cy Young Award winner was stopped for speeding at 8:23 a.m. on Oct. 30 while driving on Interstate 5, 4 miles north of the Oregon state line, according to Trooper Steve Schatzel of the Washington State Patrol. Lince was cited for driving 74 mph in a 60-mph zone.
The police report said the motorcycle officer who stopped Lince smelled marijuana in the car and asked him to produce any drugs that he had. Lince acknowledged that he did have drugs and opened the center console of his 2006 Mercedes, handing the officer 3.3 grams of marijuana, just under one-eighth of an ounce, and a pipe.
"He was placed under arrest," Schatzel said. "It was determined he was not impaired. He was cited and released at the scene. The amount of marijuana he had is about the size of your thumb."
In Washington, where Lince was born and raised, possessing less than 40 grams of marijuana is deemed personal use and a misdemeanor, with a maximum punishment of 90 days in jail and a $1,000 fine.
Although Major League Baseball has a well-publicized policy for punishing users of performance-enhancing drugs, there are no provisions in the collective bargaining agreement for punishing players who are convicted of using drugs of abuse.
In June, Cubs catcher Geovany Soto was told he tested positive for marijuana during the World Baseball Classic. He faced no sanctions from MLB.
In reality, the hit to Lince 's reputation will be worse than his criminal punishment.
The pitcher's 2010 salary might be set in salary arbitration. Although unlikely, the Giants could cite his arrest to the arbitration panel as a reason to award the 25-year-old a lower salary.
A Giants spokesman said the team still was gathering information and was not prepared to issue a statement. Calls to Lince and his agent were not returned.
Although Lince likely would have been handcuffed by the arresting officer, Schatzel said, he was not taken into custody but was cited and released on a promise to appear in Clark County District Court. An arraignment is set for Nov. 23.
Lince faces a fine of $122 for the speeding charge.
A source in the commissioner's office said that if Lince is convicted, he likely will be steered to a diversion program.

This cracked me up-I finally received an orange lincy jersey in the mail the day this story came out. ha. Whatever lincy is in the off-season carrying a pipe in his center console and wasn't under the influence. If the guy wants to smoke a little pot in the OS then so be it. I mean it's not such a shock lincy smokes a little buddha. Still love him, he is a badass pitcher who throws amazing stuff though is lacking the size of most pitchers. Right on man. I get to about 5 or so Giants games a year. Even though I grew up everywhere but the SF area (where I live now) my parents are from here so my Dad raised me as a Niner/Giants fan. Funny part is that much of my growing up and schooling was in Alabama so I went to see the Giants play the Braves every couple of years in the ATL. I even got thrown out of Turner field once for being drunk and heckling braves fans during a game in which Barry went deep. One Braves fan threw his Hotdog at me as I was escorted out to rousing cheers from the fans. I hate the Braves about as much as I do the Yankees. Good times

I actually was going to get to see him pitch late in the season, but he was scratched because of back pain, and Madison Baumgarner pitched instead. He's one of the Giants big-time prospects. Good stuff but needs to work on consistency. He'll be fighting for a 5th spot in the rotation next spring. The Giants are really loaded down in the minors for a change. I also hope they bring back Brad Penney. My jersey is an away Pablo Sandoval jersey. Kung Fu Panda!!!
As for the Spurs, My Dad wasn't a big B-ball guy, and certainly not a Warriors fan so I was left to find a team on my own. Since he (my dad) was in the military, I started following D-Robs career around the same time I started playing Basketball at about 8 years old, when I lived in the DC area.When Rob got drafted by the Spurs, I became a Spurs fan and have been ever since. I was born in Ft. Worth so it wasn't too much of a reach.
I hated the Cowboys (even then) and there was no way I was going to pull for the Mavs.
We are (as far as I know) the only Spurs/Giants fans on the board. I've got nothing against the chargers, or the raiders for that matter, because all my hatred is reserved for the Cowgirls.
