82 yr old charged with attempted murder in defense of property
An 82 year old local man has been charged with twelve felonies including four counts of 1st degree attempted murder for firing on two men who were stealing his trailer. Over the weekend, Wheat Ridge police released their statement and attempted justification for charging Robert Wallace with attempted murder for defending himself and his property with deadly force.
In February, he was watching TV in his living room when he heard a noise, investigated, and saw two men hooking his flatbed trailer up to their pick-up truck. He yelled at them to stop and they sped away with his trailer. He shot twice at the fleeing pick-up and one of the suspects ended up with a bullet in his face. The other suspect has reportedly confessed to the crime while the other was in the hospital.

It did. But that rule doesn't apply here.
Please explain further, I have never heard that term.
I haven't heard of that either.
shooting someone while they are coming at you = ok.
shooting someone while they are fleeing = big trouble.
See Wiki: Sanctuary City
What about fleeing in your property?
Still damn good shooting. A head shot when they are hauling ass in a truck...![]()
doesn't matter. Shooting someone in the back is pretty much murder.
I came damn close to doing that once. Mother er stole my suburban out of my driveway. I heard it start and came out the front door with the .44 mag. He was at the end of the driveway in the street going from reverse to drive. I had the hammer ed and drawn down on him when I had second thoughts and didn't pull the trigger.
that.
especially if they have already exited the property.
Too bad you didn't think to shoot out the tire.
Yep. Happened pretty fast. By the time I made the conscious decision not to kill him he had it in drive fishtailing down the street.
he shoulda moved to Texas, and he wouldn't be in this mess
I don't believe there is a death penalty for theft.
Castle Doctrine does not include shooting at people while they are running away from you after the crime... at least I don't think.he shoulda moved to Texas, and he wouldn't be in this mess
There would be if I caught him in my house.
Tough guy.
That guy in Houston got no-billed and that was pretty close to the same. They were ripping off his neighbors house and he shot them in the car as they were getting ready to leave.
Remember that Houston guy that killed two robbers escaping from his neighbor's house last year or so? Jury acquitted him.
That's a very generous definition of "self defense" and "castle".
I wish I was on dude's jury. No way I would convict someone for that.
I doubt he'll be convicted.
If he hadn't lied about it in the first interrogation he might have gotten a Manslaughter charge.
