I'm pretty sure it was made clear by the DoJ when Obama came into office that they wouldn't go after the Bush administration or officials. Holder is just following through on dismissing the worst charges so some low-level dude/dudette can find some non-serious charges to peg them for that we'll never hear about but eventually will look back on and say "we'll at least they got charged with something."
