Manhattan Federal Judge Alvin erstein has declined to hold the CIA in contempt for destroying videos that it had been ordered by the courts to preserve.
The case revolves around 92 videos, depicting hundreds of hours of interrogations of detainees. The tapes allegedly contained evidence of torture, and the CIA was ordered by numerous courts to produce the videos in relation to lawsuits arising from torture allegations. The 9/11 Commission also demanded that the tapes be produced. Instead, the agency destroyed them.

In theory, yes. In practice, I bet he and Congress know only a tiny of bit what CIA/NSA are up to.
I am not interested in your assessment of likelihood. You made an assertion and I wanted you to explain. Are you now just saying you're talking out of your ass? That would be a 1st.
One hand covers up the other. The independent judiciary sometimes doesn't appear to be independent . . .
Coequal government requires balls. The legislative and the judiciary would seem to be lacking.
More contumacious behavior is hardly imaginable. The CIA destroyed evidence a court ordered them to produce after receiving the order.

GWB did give George Tenet the Medal of Freedom for falling on his sword over the WMD non-issue, so you might have a point there.
